How Long After Divorce Can You Remarry in South Africa?

There is no mandatory waiting period. South African law does not require you to wait any specific number of days, months, or years after your divorce before entering a new marriage.

However, you cannot remarry until the Department of Home Affairs has updated your marital status on the National Population Register from "Married" to "Divorced." If the register still shows you as married, a marriage officer cannot legally solemnise a new marriage.

How the National Population Register Gets Updated

When a court grants a divorce decree, the court registry is supposed to notify the Department of Home Affairs to update the National Population Register. In practice, this notification can take weeks to months — and sometimes falls through the cracks entirely.

If you're planning to remarry, don't assume the update has happened. Verify your marital status before setting a wedding date:

• Visit your nearest Home Affairs branch and request a marital status verification
• Alternatively, check via the DHA online system if available in your area
• Bring your certified divorce decree in case the system still shows you as married

If the update hasn't been processed, present your certified decree at Home Affairs and request an immediate correction. Having the decree on hand (court-certified, not a photocopy) accelerates the process.

Letter of No Impediment

If you're remarrying abroad, many foreign governments require a Letter of No Impediment (also called a Certificate of No Impediment or Single Status Certificate) issued by the South African government. This confirms that you're legally free to marry.

To obtain one:

1. Apply at your nearest South African embassy or consulate, or at a Home Affairs branch if you're applying from within South Africa
2. Submit your certified divorce decree, current ID or passport, and a completed application form
3. Pay the applicable fee (varies by embassy)
4. Processing typically takes two to four weeks

The letter of no impediment won't be issued if the National Population Register still shows your status as "Married" — which is another reason to verify and correct your status before applying.

Choosing a Matrimonial Property Regime for the New Marriage

When you remarry, you need to actively decide on a matrimonial property regime. If you do nothing, the default is community of property — meaning all assets and debts are shared with your new spouse from day one.

If you want to marry out of community of property (with or without accrual), you must execute an antenuptial contract (ANC) before the marriage. The ANC must be:

• Drafted by a notary (a practising attorney who is an admitted notary)
• Signed by both parties before the notary
• Registered at the Deeds Office within three months of execution

An ANC typically costs between R3,000 and R5,000 for a standard contract. Given that you've already been through one divorce and know exactly how property division works, this is worth the investment.

Religious and Customary Marriages

The Marriage Act (Act 25 of 1961), the Civil Union Act (Act 17 of 2006), and the Recognition of Customary Marriages Act (Act 120 of 1998) all require that the parties be legally free to marry. This means the National Population Register must reflect your divorced status regardless of whether you're entering a civil, religious, or customary union.

For customary marriages, additional requirements may apply depending on the specific customs involved, but the legal prerequisite of being unmarried remains the same.
