Maiden Name Reversion vs. Formal Name Change

There's an important distinction. Reverting to your maiden surname (or a previous married surname) under Section 26(2) does not require a BI-196 application or Director-General approval. It's treated as a restoration, not a new name.

Assuming a completely different surname — one you've never held — requires a formal application through the Director-General of Home Affairs, publication in the Government Gazette, and an average processing time of 36 months. That's a different process entirely.

For post-divorce maiden name reversion, you're looking at two to three weeks.

Documents You Need

Gather these before booking your appointment:

• Certified copy of your divorce decree (court-stamped, not police-certified)
• Current Smart ID card
• Unabridged birth certificate showing your maiden surname
• Two passport-size photos (for the new Smart ID)
• Marriage certificate (some offices request this as backup)

If you've lost your divorce decree, contact the court registry where the divorce was finalized. You'll need the case number — check your attorney's correspondence if you don't have it.

How to Book and Apply

You have two options for submitting your application:

eHomeAffairs portal: Book an appointment at services.dha.gov.za. Select your nearest Home Affairs branch and the "Smart ID Card" service. Slots fill quickly at metro offices — try branches in smaller towns if nothing is available.

Bank branches with DHA biometric terminals: ABSA, FNB, Nedbank, and Standard Bank branches equipped with Home Affairs terminals can process the application. These tend to have shorter queues than DHA offices.

At the appointment, you'll provide your biometric data (fingerprints and photo) for the new Smart ID. The system updates the National Population Register with your restored surname.

Processing Times

A new Smart ID typically arrives within two to three weeks. A passport takes two to four weeks. Both timelines assume no backlogs at your specific office — metro areas sometimes run longer.

What to Update After Getting Your New Smart ID

Your new Smart ID triggers a cascade of updates across every institution that holds your old married name:

• Bank accounts: Present the new Smart ID and divorce decree to update account holder details
• Employer HR and payroll: Update your name for tax certificates and UIF records
• SARS eFiling: Submit a Request for Correction with the new ID
• Medical aid: Update your membership details
• Vehicle registration (eNaTIS): Update owner particulars within 21 days
• Municipal utilities: Update billing name with the decree and new ID
• Cell phone contracts: RICA re-registration with the new ID

The sequence matters — banks won't process a surname change without the new Smart ID, so the Home Affairs step must happen first.

Passport Renewal After Name Change

If you travel internationally, apply for a new passport after receiving your Smart ID. You'll need the new Smart ID, one passport photo, and the R400 application fee. Applications go through the same eHomeAffairs portal or bank branches.

Until the new passport arrives, you can travel on your existing passport with the certified divorce decree as supporting documentation — but some border officials may question the name discrepancy, so carry both documents.
