Remarriage After Divorce Singapore: Waiting Period and Requirements

You Cannot Remarry Until the Final Judgment

This is the most common point of confusion. When the court grants your divorce, it first issues an Interim Judgment — this confirms that the marriage has irretrievably broken down. But the Interim Judgment does not dissolve your marriage. You are still legally married.

A statutory waiting period of at least three months must pass before the plaintiff can apply to make the Interim Judgment final. The defendant may also apply if the plaintiff has not. Only after the Certificate of Final Judgment is extracted is your marriage legally dissolved. Until that certificate is in hand, you cannot marry anyone else — attempting to do so constitutes bigamy under Singapore law.

The Three-Month Timeline

Here's the sequence for civil divorces:

1. Court grants Interim Judgment — your divorce case succeeds on the ground of irretrievable breakdown
2. Three-month statutory wait — the plaintiff cannot apply for the Final Judgment until at least three months have passed
3. Application for Final Judgment — the plaintiff applies (the defendant can also apply if the plaintiff hasn't)
4. Certificate of Final Judgment issued — your marriage is legally dissolved
5. You can now remarry

The three months run from the date the Interim Judgment was granted, not from the date of filing. If there are unresolved ancillary matters (custody, maintenance, asset division), the court may delay the Final Judgment until those are settled — which can push the actual dissolution well beyond three months.

Muslim Divorces: A Different Structure

For Muslim divorces through the Syariah Court, the timeline follows a different structure and does not use the civil Interim/Final Judgment sequence. The Syariah Court pronounces the divorce, and the Sijil Cerai (Certificate of Divorce) is issued after the divorce is registered. Confirm any applicable waiting period and ROMM requirements with the Syariah Court for the particular divorce.

What You Need to Register a New Marriage

Once your Certificate of Final Judgment (civil) or Sijil Cerai (Muslim) is in hand, you can begin the applicable ROM or ROMM registration process, subject to the requirements for your particular divorce.

Documents you'll need:

• Your Certificate of Final Judgment or Sijil Cerai
• Your NRIC (updated if you changed your name post-divorce)
• If you're marrying a foreigner, their passport and any additional immigration documents

Filing fees: Standard ROM filing fees apply — the marriage solemnization fee depends on the venue and date chosen.

Timing note: ROM has advance-notice requirements before solemnization, so check its current instructions if you're planning to remarry soon after the Final Judgment.

Administrative Implications of Remarriage

Getting remarried triggers its own set of administrative updates:

• Your new marriage automatically revokes any existing will — you'll need to draft a new one after the ceremony
• Your CPF nomination is also automatically revoked by marriage — make a new nomination after remarriage
• HDB eligibility may change — if you retained an HDB flat as a single citizen, forming a new family unit with a new spouse may affect your scheme eligibility or unlock new options
• Tax filing status changes — update IRAS with your new marital status
