Update Insurance After Divorce in South Africa

Insurance policies are easy to forget in the chaos of post-divorce admin. But leaving your ex-spouse on your policies — or failing to update address and driver details — can void claims when you need them most.

Here's what needs to change across each type of insurance.

Car Insurance

Remove your ex-spouse as a named or regular driver. If your ex-spouse is listed as a regular driver on your vehicle insurance and they no longer drive the car, keeping them on the policy doesn't help you — and omitting to update the driver profile is a misrepresentation that can void a claim.

Update the registered owner. If vehicle ownership changed under the settlement agreement, the new owner needs their own insurance policy. You can't insure a vehicle you don't own. Update the eNaTIS registration within 21 days of the ownership change (National Road Traffic Act requirement), then arrange new insurance in the new owner's name.

Review your excess and cover level. After divorce, your risk profile changes. If you've moved to a different area, your premiums may increase or decrease. If you've gone from two vehicles to one, shop around — you may qualify for better rates as a single-vehicle household.

Home Insurance

Update your address immediately. If you've moved out of the family home, your home contents insurance needs to reflect your new address. Insurers assess risk based on location — a claim filed at an address different from the one on your policy can be declined.

Review the sum insured. If you kept the family home but your ex-spouse took furniture, electronics, or valuables, your contents cover is now too high. If you moved into a smaller place with fewer belongings, reduce the insured amount. Overpaying for cover you don't need is money wasted; underpaying means shortfall claims.

Building insurance on bonded property. If the property has a mortgage, building insurance is mandatory and typically held through the bank. After a Section 57 bond substitution, confirm with the bank that building insurance is still in place and that the policy reflects the current sole owner.

Life Insurance

This is the one that catches people out.

Life insurance companies pay the named beneficiary, not the person in your will. If your ex-spouse is the named beneficiary on your life policy and you die without updating the nomination, the insurer will pay your ex-spouse — regardless of what your new will says. The policy contract overrides the will.

To update:

  1. Contact your insurer and request a beneficiary nomination change form
  2. Complete and return the form naming your new beneficiaries (children, parents, a trust)
  3. Confirm in writing that the change has been processed — keep the acknowledgment

This takes 24 to 48 hours once the insurer receives the form. There's no cost.

Review the cover amount. If your life insurance was designed to cover joint financial obligations (a shared bond, school fees for both households), your coverage needs may have changed. You may need more cover (if you're now a single parent responsible for maintenance) or less (if financial obligations have reduced).

Maintenance-linked policies. If the divorce order includes a maintenance obligation, consider whether your current life insurance adequately covers the capitalised value of that obligation. If you die, the maintenance obligation doesn't automatically continue — your estate needs sufficient funds to settle the capitalised maintenance amount. Your settlement agreement may explicitly require you to maintain life insurance for this purpose.

Funeral Cover and Hospital Plans

Don't overlook these smaller policies. If your ex-spouse was included on your funeral cover or hospital cash plan, they need to be removed. Most providers require a written instruction and a copy of the divorce decree to process the removal.
