Updating Insurance After Divorce in Wisconsin
Insurance is one of the first things that needs to change after a Wisconsin divorce and one of the last things people get around to. Every shared policy — auto, homeowners, life, umbrella — assumes a married household. Leaving those policies unchanged after the decree creates coverage gaps, overpayments, and liability exposure that can cost thousands when something goes wrong.
Life Insurance
If your divorce decree requires one spouse to maintain a life insurance policy (usually to secure maintenance or child support obligations), confirm the policy is in force, the coverage amount matches the decree, and the beneficiary designation is correct.
For any life insurance policy where your ex-spouse is the named beneficiary and the decree does not require it, change the beneficiary immediately. Wisconsin's automatic revocation statute (§ 854.15) covers private life insurance policies, but the insurer may not know about your divorce. If you die before the insurer receives written notice, the company can pay your ex-spouse in good faith under Bersch v. VanKleeck — and your intended beneficiaries would have to sue to recover the funds.
Contact your insurer, file a new beneficiary designation form, and send written notice of your divorce. Get confirmation in writing.
Auto Insurance
If you shared an auto insurance policy during the marriage, you need to separate it. Keeping your ex-spouse on your policy after the divorce means they have a financial interest in the policy and any claims — and you are paying for their coverage.
Contact your insurer and either:
- Remove your ex-spouse from the existing policy (if you are the policyholder and keeping the car), or
- Get a new individual policy on the vehicle awarded to you
If your ex was the primary policyholder, you will need to set up your own policy entirely. Shop around — your rate as a single driver may differ significantly from the married rate.
Make sure the named insured on each vehicle's policy matches the person who owns the vehicle per the divorce decree and the updated title. A mismatch between the titled owner and the insured can create coverage disputes if you file a claim.
Homeowners Insurance
If you are keeping the marital home, update the homeowners policy to reflect sole ownership. The policy should list only you as the named insured once the quitclaim deed is recorded and the title is in your name alone.
If your ex-spouse is keeping the home, remove yourself from the policy. You do not want to remain as a named insured on a property you no longer own — it creates liability without benefit.
Review your coverage amounts. A policy designed for a two-income household may carry more coverage (or less) than you need as a single homeowner. Check that the dwelling coverage still matches the home's replacement cost and that your personal property coverage reflects what you actually own after the property division.

Umbrella Insurance
If you had an umbrella liability policy during the marriage, it typically extends over all underlying auto and homeowners policies. After divorce, you need a separate umbrella policy (or to cancel the shared one) that aligns with your individual auto and homeowners coverage.
When to Make These Changes
Start in the first week after your divorce is finalized. Auto and homeowners changes are quick — a phone call to your agent. Life insurance beneficiary changes require a written form. Do not wait for renewal dates; most mid-term policy changes can be processed immediately.
