Legal Aid for Divorce in Ireland: How to Get Free or Low-Cost Legal Help

Solicitor fees for an Irish divorce range from €1,500 for a straightforward consent case to €50,000+ for a fully contested hearing. If you can't afford private representation, the Legal Aid Board (LAB) provides civil legal aid and advice for family law matters, including divorce, at heavily subsidised rates — sometimes as low as €30.

What the Legal Aid Board Covers

The LAB provides solicitor representation for family law proceedings including divorce applications, judicial separations, custody and access disputes, maintenance applications, domestic violence orders (barring orders, safety orders), and disputes over the family home.

Family law is the LAB's biggest area of work. Their solicitors handle the full process: advising on your options, drafting the Affidavit of Means, preparing court documents, negotiating settlement terms, and representing you in Circuit Court hearings.

The LAB does not cover criminal matters, conveyancing, or commercial disputes.

Eligibility: The Means Test

To qualify for civil legal aid, your disposable income must fall below a threshold set by the Civil Legal Aid Regulations 1996 (as amended). The assessment looks at your income after deducting:

• Tax, PRSI, and USC
• Reasonable housing costs (rent or mortgage)
• Childcare expenses
• Maintenance payments you're making
• An allowance per dependent child

If your disposable income is below the threshold, you qualify. Your disposable capital (savings, investments — excluding the family home and household contents) is also assessed, with a separate capital threshold.

The key point: the means test uses your individual income after separation, not the combined household income during the marriage. If your spouse earned the bulk of the household income and you have limited personal earnings, you may well qualify even if the family's total income was substantial.

What It Costs

Even with legal aid, you pay a contribution:

• Legal advice (initial consultation and written advice): contribution of €30
• Legal aid (full court representation): contribution starting at €130

These contributions can be reduced or waived in cases of financial hardship. In practice, the total cost for a legally aided divorce is dramatically less than private solicitor fees.

How to Apply

1. Contact your nearest Law Centre. The LAB operates 34 full-time and part-time law centres across Ireland. You can find your nearest centre on legalaidboard.ie or call their information line.

2. Complete an application form. You'll need to provide proof of income (pay slips, social welfare statements), details of your financial situation, and a summary of your legal issue.

3. Attend a means assessment. A staff member reviews your financial documents against the eligibility thresholds.

4. Wait for an appointment. This is the main drawback. Demand for LAB family law services consistently exceeds supply. Waiting times for a first consultation can range from several weeks to several months depending on your location. Dublin and Cork law centres typically have the longest waits.

The Waiting Time Problem

The LAB's waiting lists are a genuine obstacle. While you wait, your divorce proceedings aren't progressing — and your financial situation may be deteriorating. Some strategies to manage the wait:

• Request priority. Cases involving domestic violence, child protection, or urgent housing issues may be prioritised.
• Use the free mediation service. The Family Mediation Service (also run by the LAB) has shorter waiting times and can help you reach agreement on financial terms, custody, and access before you need a solicitor for the formal court process.
• Prepare your financial disclosure. Use the waiting period to compile twelve months of bank statements, pay slips, tax returns, and pension statements. When your solicitor appointment finally comes, you'll save time and money by arriving prepared.

Private Solicitors and the Family Mediation Service

If you don't qualify for legal aid but can't afford full-rate solicitor fees, some options:

• Fixed-fee consent divorce packages. Several Irish solicitors offer flat-rate packages for uncontested divorces, typically €1,500–€3,000 for both sides combined.
• The Family Mediation Service. Free, state-funded mediation available to all separating couples regardless of income. Mediators help you negotiate financial terms and parenting arrangements. You still need a solicitor to formalise the agreement and present it to court, but the solicitor's involvement is much shorter and cheaper.
