In South Australia, name changes are handled by Consumer and Business Services (CBS SA), not the courts. The divorce order itself doesn't change your name — it gives you the legal basis to do so.
Option 1: Revert to Your Birth Name (Free)
If you took your spouse's surname when you married and want to revert to your birth name (maiden name), you don't need a formal name change application. Your divorce order, combined with your birth certificate, is sufficient proof for most institutions.

What you need:
- Your sealed divorce order (showing your married name)
- Your original birth certificate (showing your birth name)
Take both documents to each institution and request the name reversion. Most organisations process this within a few days to a few weeks.
Option 2: Formal Change of Name (For a Different Name)
If you want to change to a name that's neither your married name nor your birth name — or if you want an official change of name certificate for convenience — you apply through CBS SA.
Cost: $72 for a change of name certificate (2026 rates).
Process:
- Complete the change of name application through the CBS SA website or in person
- Provide proof of identity (birth certificate, passport, or citizenship certificate)
- Pay the fee
- CBS SA processes the application and issues a Change of Name Certificate
- Use the certificate to update your records across all institutions

Once you have your documentation (divorce order + birth certificate, or change of name certificate), update your records in this order:
Priority 1 — Identity documents:

- Australian passport (Department of Foreign Affairs and Trade)
- Medicare card (Services Australia / MyGov)
Priority 2 — Financial institutions:
- Banks and credit unions (all accounts, credit cards, loans)
- Superannuation funds
- Insurance policies (home, car, health, life)
- ATO records (via MyGov)
Priority 3 — Property and government records:
- Land title (Land Services SA — if you retained property in the settlement)
- Vehicle registration (Service SA)
- Electoral roll (AEC — mandatory to update within 21 days)

Name Change for Children
Changing a child's surname after divorce is a separate and more complex process. It requires the consent of both parents, or a court order if consent can't be obtained. This is governed by the Births, Deaths and Marriages Registration Act 1996 (SA) and requires an application through CBS SA.
