How to Update Social Security After Divorce in Kentucky

Updating your Social Security record is the single most important first step after your Kentucky divorce is finalized. Every other identity update — your driver's license, bank accounts, employer records — depends on your SSA record being current. Skip this step and you will hit a wall at the Kentucky Transportation Cabinet.

Why SSA Must Come First

Kentucky's driver licensing system performs real-time verification against the federal Social Security database. When you visit a Regional Driver Licensing Office, the system checks that your name and Social Security number match what the SSA has on file. If you changed your name through the divorce decree but have not updated the SSA, the system flags a mismatch and your application is rejected.

This is not a suggestion — it is a hard technical dependency. SSA first, driver's license second, everything else after.

How to Complete the Update

Form SS-5 (Application for a Social Security Card) is the only form you need. You can download it from ssa.gov or pick one up at your local Social Security office.

Required documents:

  • Completed Form SS-5
  • Certified copy of your Kentucky divorce decree showing name restoration (the raised clerk's seal is required)
  • Valid, unexpired photo ID (current driver's license, state ID, or passport)

Where to go: Visit any Social Security office — you do not need to go to the office closest to your Kentucky address. Walk-ins are accepted, but scheduling an appointment at ssa.gov reduces wait times significantly.

Cost: Free. There is no charge for updating your name or obtaining a replacement Social Security card.

Processing time: The database typically updates within 24-48 hours, but your new physical card arrives by mail in 10-14 business days. You do not need to wait for the physical card before visiting the Transportation Cabinet — the database update is what matters.

What to Bring vs. What They Will Not Accept

SSA requires original documents or certified copies — photocopies, notarized copies, and faxes are not accepted. Your certified divorce decree must show the court's raised seal. If your decree does not include a name restoration provision, you will need a separate court order (Form AOC-450) granting the name change.

SSA will not accept an expired driver's license as your photo ID. If your only photo ID is expired, bring your passport or arrange to renew your state ID before the SSA visit.

Divorced Spouse Social Security Benefits

A separate but related question: if your marriage lasted at least 10 years, you may be eligible to collect Social Security benefits based on your ex-spouse's earnings record. This does not reduce your ex-spouse's benefits, and you do not need their permission.

To qualify, you must be at least 62 years old, currently unmarried, and your own benefit must be less than what you would receive on your ex-spouse's record. If you remarry, you lose eligibility for ex-spouse benefits unless the subsequent marriage also ends.
