How to Update Social Security After Divorce in Hawaii

Why SSA Comes First

Updating your Social Security record is the foundational step in the post-divorce identity chain. The DMV checks the SSA database before issuing a new driver's license. Banks verify your Social Security number against SSA records. If you update your license before SSA has processed the change, the DMV's real-time SSA verification will flag a mismatch and reject your application.

That makes SSA the mandatory first stop after you have your certified divorce decree in hand.

What You Need

Form SS-5 (Application for a Social Security Card). Download it from ssa.gov or pick up a paper copy at your local SSA office. The form is straightforward — name, date of birth, citizenship, the name change you're requesting, and whether you want a replacement or corrected card.

Your certified divorce decree. This is the legal connecting document that proves your name change. The SSA requires an original or certified copy — they will not accept photocopies. The decree must contain specific language restoring your former name (e.g., "Wife shall resume the use of her birth surname and shall be known hereafter as [Full Name]").

If your decree does not include name restoration language, the SSA cannot process a name change based on the decree alone. You would need an administrative name change order from the Office of the Lieutenant Governor instead.

One form of current identity. The SSA needs proof that you are who you say you are. Acceptable documents include a valid U.S. passport, current state driver's license, or state-issued ID card.

How to Submit

In person at a Hawaii SSA office. Walk-in or by appointment at:

Bring your originals — the SSA examines them and returns them to you the same day. Do not mail original documents unless absolutely necessary.

By mail. If you can't visit in person, mail Form SS-5 with your certified decree and identity document to your nearest SSA office. They'll return your originals by mail after processing. The risk here is that your certified decree is in the mail system for several weeks — which is why most people prefer the in-person route.

Timeline and Cost

Processing takes three to four weeks from the date SSA receives your application. Your new Social Security card arrives by mail — there is no fee for a replacement or corrected card.

The important detail: your SSA record updates in their database before the physical card arrives. You can call the SSA or visit the office to confirm the database reflects your new name, then proceed to the DMV without waiting for the card itself.

What About Social Security Benefits After Divorce?

If your marriage lasted at least 10 years and you are at least 62 years old, you may be eligible for Social Security benefits based on your ex-spouse's work record. This applies even if your ex has remarried. Claiming these benefits does not reduce your ex-spouse's own benefit amount.

You can collect the higher of your own earned benefit or up to 50% of your ex-spouse's full retirement benefit. If your ex-spouse has died, you may be eligible for survivor benefits worth up to 100% of their benefit amount — and remarriage after age 60 does not disqualify you.

Note that the Government Pension Offset and Windfall Elimination Provision, which previously reduced Social Security benefits for people receiving government pensions, were repealed by the Social Security Fairness Act signed in January 2025. If your benefits were previously reduced under these provisions, SSA has already processed retroactive adjustments back to January 2024. If you never applied because of these offsets, you'll need to file a new claim — the adjustment is not automatic for non-filers.
