Documents Needed for Divorce Ireland

The Four Core Documents

Every divorce application in Ireland requires a minimum of three documents (four if you have dependent children). These are non-negotiable — the Circuit Court won't accept your case without them.

1. Family Law Civil Bill (Form 2N)

This is the initiating document — your formal application to the court. It sets out:

• The date and place of your marriage
• Your separation dates (you need at least two of the past three years living apart)
• Names and birth dates of any dependent children
• A comprehensive list of every relief you're asking for: property transfer, maintenance, pension adjustment, custody, access

The reliefs section is the most important part to get right. You can only obtain orders that you've actually requested in your Civil Bill. If you forget to include a claim for a Pension Adjustment Order, for example, you'll need to amend the Civil Bill before the hearing — which adds delay.

2. Affidavit of Means / Statement of Truth of Means (Form 37A)

Your full financial disclosure. This document requires:

• Income. Weekly or monthly earnings from employment, self-employment, rental income, social welfare payments, investment returns, and any other source.
• Outgoings. Mortgage or rent, utility bills, food, transport, childcare, insurance, loan repayments — a comprehensive monthly budget.
• Assets. Bank balances, property values, vehicle values, investments, savings.
• Debts. Mortgage balance, credit card balances, personal loans, overdrafts.
• Pension entitlements. Current transfer values for all occupational and personal pension schemes.

On the paper track, this is a sworn affidavit — you sign it before a commissioner for oaths (€10 per signature, €2 per exhibit). On the Courts Portal, it's an electronic Statement of Truth that doesn't require a commissioner.

Every figure in this document should be accurate and supportable. In contested cases, the County Registrar will require "vouching" — meaning you'll need to produce bank statements, payslips, and tax returns that verify the numbers.

3. Affidavit of Welfare / Statement of Truth of Welfare (Form 37B)

Required only if you have dependent children. This document covers:

• Current living arrangements for each child
• Education (school names, any special needs provisions)
• Health and medical arrangements
• Existing maintenance payments
• Current access and custody arrangements
• Any concerns about the children's welfare

The same paper/portal distinction applies: sworn affidavit on paper, electronic statement of truth on the portal.

4. Marriage Certificate

You must supply the original state-issued marriage certificate — not a photocopy. If the certificate is in a language other than English or Irish, you'll need to attach a certified translation.

If you've lost the original, you can order a replacement from the General Register Office (GRO) through the HSE marriage-certificate service. Delivery times vary; the HSE aims to post online orders within 20 working days.

Documents You Don't Need (If You're Self-Represented)

Mediation Certificate (Form 37D). This is a form signed by a solicitor certifying that they discussed mediation, reconciliation, and separation agreements with the client. Self-represented litigants are explicitly exempt from this requirement. Don't waste time trying to obtain one.

Supporting Evidence to Prepare

Beyond the four core documents, you'll want the following ready — especially if your case is contested or if the judge probes your eligibility:

Residency evidence. Utility bills, lease agreements, employment contracts, or Revenue documents proving at least one spouse has been ordinarily resident in Ireland for twelve months before filing.

Separation evidence. If you're claiming a same-roof separation (living apart under the same roof), you'll need a narrative in your Civil Bill explaining separate bedrooms, separate finances, and separate domestic routines. Supporting evidence might include separate bank accounts, correspondence with family or friends confirming the separation, or sworn statements from housemates or relatives.

Vouching documents for the Affidavit of Means. Bank statements (twelve months), recent payslips (three to six months), P60 or Employment Detail Summary, property valuations, pension benefit statements, mortgage statements, and loan statements. The County Registrar in contested cases — or the judge in consent cases — may ask for any of these.

Pension documentation. If you're seeking a Pension Adjustment Order, you'll need a benefit statement from each relevant pension scheme and ideally an actuarial report (€500–€1,500) calculating the transfer value and proposed split.

Filing Checklist

Paper track — submit three copies of each completed form to the Circuit Family Court office for the county where either spouse lives or works:

Court filing fees for both tracks: €0. All family law proceedings are exempt.

Stay Organised From the Start

Getting the documents right the first time prevents the most common delays — forms bounced by the court office for missing exhibits, hearings adjourned because financial statements are stale (they must be within six months of the hearing date), or Case Progression hearings stalled because vouching evidence wasn't assembled.
