Where to File for Divorce in Idaho: County Venue Rules and Court Locations

Idaho's Venue Rule for Divorce

Under Idaho Code § 5-404, you must file your divorce petition in the district court (magistrate division) of the county where the respondent currently resides. Not where you live. Not where you got married. Where your spouse lives right now.

There are two exceptions:

  1. Respondent lives outside Idaho — if your spouse doesn't live in the state, you can file in any Idaho county
  2. Respondent's location is unknown — if you genuinely cannot determine which county your spouse lives in, you can file in any Idaho county and pursue service by publication

If you file in the wrong county, a party can move for a change of venue under IRFLP Rule 105. A mandatory improper-venue motion generally must be made no later than 14 days after the responsive pleading, subject to the rule's exceptions; filing correctly avoids delay and possible sanctions.

Idaho's Seven Judicial Districts

Idaho's 44 counties are organized into seven judicial districts. Your county determines your judicial district, which affects local court procedures, parenting class options, and available self-help resources.

Ada County (Fourth Judicial District — Boise)

Ada County handles the highest volume of family law cases in Idaho. Expect longer processing times: uncontested stipulated cases typically take 60 to 90 days rather than the 30 to 45 days common in smaller counties.

The Ada County Courthouse is at 200 W. Front Street, Boise. The clerk's office accepts both in-person paper filings and electronic filings through the iCourt portal. The filing fee is the standard $207, though Ada County's technology surcharges can push the total to approximately $221.

The Fourth District Court Assistance Office offers walk-in help with form completion and provides information about the Focus on Children parenting class.

Kootenai County (First Judicial District — Coeur d'Alene)

Kootenai County is the second-largest filing jurisdiction in northern Idaho. The courthouse is at 324 W. Garden Avenue, Coeur d'Alene.

Kootenai has some notable local requirements: the county runs its own family law workshops, and the Court Assistance Office hosts regular sessions to help self-represented filers complete parenting plans and child support worksheets. If your case involves children, check the Kootenai County court website for the current class schedule — the format and availability change periodically.

Canyon County (Third Judicial District — Caldwell/Nampa)

Canyon County is the fastest-growing filing jurisdiction in southwestern Idaho. The courthouse is at 1115 Albany Street, Caldwell.

The Third Judicial District operates its own Focus on Children program with a dedicated scheduling page listing upcoming class dates and registration details. Canyon County also offers Zoom workshops for form assistance.

Bannock County (Sixth Judicial District — Pocatello)

Bannock County provides some of the most detailed self-help resources in the state. The Bannock County website hosts downloadable, fillable form packets organized by case type — divorce with children, divorce without children, response to petition — with step-by-step instruction sheets included in each packet.

The courthouse is at 624 E. Center Street, Pocatello. The Court Assistance Office is available for walk-in help during regular business hours.

Twin Falls County (Fifth Judicial District)

Twin Falls serves as the hub for south-central Idaho. The courthouse is at 427 Shoshone Street North, Twin Falls. The Fifth Judicial District has its own Family Court Services program and parenting class options.

Tips for Choosing Correctly

  • Look at where your spouse actually lives, not where they work or receive mail. Physical residence determines venue.
  • If your spouse moved recently, the controlling address is where they reside at the time you file — not where they lived when you separated.
  • If both of you moved to different counties after separating, file in the county where the respondent landed.
  • Military members: if your spouse is active-duty military and is the respondent stationed in Idaho, their duty station may identify the respondent's county for venue. If the respondent is stationed outside Idaho, the outside-Idaho exception allows filing in any Idaho county.

What If You File in the Wrong County?

A filing in the wrong county is not automatically dismissed. Under IRFLP Rule 105, a party may move for a change of venue, and if the motion is granted, the case moves to the correct county. An improper filing can cause processing delays and possible sanctions.

Do not assume that silence cures improper venue. Verify venue before filing; IRFLP Rule 105 governs when the court must change venue and when the issue may be raised.
