Idaho Divorce Filing Fee
The Base Filing Fee: $207
The standard fee to open a domestic relations case (including divorce) in Idaho's magistrate division is $207 statewide. This amount is set by the Idaho Supreme Court under the statewide fee schedule (Appendix A to the Idaho Rules of Civil Procedure) and applies uniformly regardless of whether you have children, how much property is involved, or which county you file in.
However, several counties tack on local technology surcharges and court facility fees that push the actual cost higher. Ada County, for example, charges up to $221 when local surcharges are included. These county-level additions are approved under individual district administrative rules and change periodically.
Electronic Filing Fees
If you file through Idaho's iCourt File & Serve portal (Tyler Technologies), there is an additional $5 electronic filing transaction fee per submission. This fee goes to Tyler Technologies, not the court, and applies to each electronic envelope you submit.
Paper filing at the courthouse clerk window does not carry this surcharge, but some districts are moving toward mandatory e-filing for all self-represented litigants. Check with your district court clerk to confirm whether paper filing is still accepted.
Payment-processing charges may also apply; check the current iCourt portal or clerk's office for the amount.
The Respondent's Appearance Fee
If the respondent files a written response or counterclaim, they pay a separate appearance fee of $136. This is the respondent's cost, not the petitioner's, but it is important to account for when calculating the total household cost of the divorce.

Fee Waiver: Idaho Code § 31-3220
If you cannot afford the filing fee, Idaho allows you to request a waiver under Idaho Code § 31-3220 and the applicable court rules. The process:
File a Motion and Affidavit for Fee Waiver (CAO FW 1-9) — This form requires a detailed, sworn breakdown of your income, expenses, assets, and debts. You list all sources of income (wages, benefits, support payments) and all monthly obligations (rent, utilities, food, childcare, medical).
Submit a proposed Order Re: Fee Waiver (CAO FW 1-10) — This is the order the judge signs if they approve your request.
Submit both with your Petition — File the fee-waiver application with the initiating documents. The court reviews the affidavit and decides whether you are indigent; if the waiver is denied, follow the notice's payment or resubmission instructions to keep the case active.

Idaho Code § 31-3220 does not set a single income threshold; the court determines indigency after reviewing the sworn affidavit, including income, spouse's income, property, dependents, debts, and monthly expenses.
If the judge denies the waiver, you receive notice and must follow the specified payment or resubmission instructions to keep your case active.
After a finding of indigency, Idaho Code § 31-3220(6) provides for process and service to be issued without charge through the court; ask the clerk which other costs are covered by the order.
