Update Driver License and REAL ID After Divorce in Minnesota

The 30-Day Name Change Deadline

Minnesota law requires you to apply for a new driver's license or state ID within 30 days of a legal name change. A name restoration granted in your Judgment and Decree counts as a legal name change, so the clock starts the day the court administrator enters your decree.

The 30-day application requirement still applies; complete the update promptly to avoid identity-verification problems at traffic stops, airport security, and government offices. Get it done early.

Update Social Security First

The Minnesota Department of Public Safety's Driver and Vehicle Services (DVS) system verifies your name against the Social Security Administration database. If your SSA record still shows your married name, DVS will reject your application at the counter.

Submit Form SS-5 to a local SSA field office with your certified Certificate of Dissolution and a valid photo ID. Processing takes 10 to 14 business days. Do not visit a DVS office until you confirm the SSA update is complete — either by receiving your new Social Security card or by calling SSA to verify.

What to Bring to DVS

Visit any DVS renewal office (not a deputy registrar that only handles vehicle transactions). You will need:

• Your current Minnesota driver's license or state ID — even though the name is outdated
• A certified copy of your Certificate of Dissolution (Form DIV103) containing the name change order — plain photocopies are not accepted
• Payment — driver's license fees are typically $26–$40 depending on the card type

If you are also updating your address, bring a utility bill or bank statement showing your new address.

Upgrading to REAL ID at the Same Time

If your current license is not REAL ID-compliant (it will have a gold star in the upper right corner if it is), consider upgrading during the same visit. Since May 7, 2025, you need a REAL ID-compliant license, an Enhanced license, or another federally approved ID to board domestic flights or enter certain federal facilities.

A REAL ID upgrade requires additional documents beyond the standard name-change application:

• Proof of identity, date of birth, and legal U.S. presence — a certified U.S. birth certificate or unexpired U.S. passport, for example. Your certified Certificate of Dissolution proves the name change, not identity or date of birth
• A document containing your full Social Security number (such as a Social Security card, W-2, or 1099) — DVS verifies it against SSA records; update your SSA record before applying
• Two proofs of Minnesota residency — utility bills, bank statements, lease agreements, or mortgage documents showing your current address

Your identity and residency documents should match the name on your application. If names differ, bring original proof of each name change; a certified Certificate of Dissolution can serve as name-change proof.

Enhanced Driver's License Option

Minnesota also offers an Enhanced Driver's License (EDL), which meets REAL ID standards and serves as a U.S. border-crossing document for land and sea travel to Canada, Mexico, Bermuda, or the Caribbean. The EDL adds $15 to the applicable license or ID card fee and requires proof of U.S. citizenship (a birth certificate or passport). It is not a replacement for a passport for air travel.

After Your License Is Updated

Your new license arrives by mail; processing and delivery times vary. DVS issues a temporary paper license that remains valid until the expiration date listed on it or until your permanent license arrives.

Once you have your updated license, use it as your primary identity document for the rest of your post-divorce administrative updates: bank accounts, auto insurance, employer HR, professional licensing boards, and voter registration. Having a current ID with your legal name prevents rejections at every subsequent step.
