How to Update Your Driver's License After Divorce in Montana

Wait for Social Security First

The Montana Motor Vehicle Division verifies your identity against the federal Social Security database. If your SSA records still show your married name when you walk into the MVD, their system flags a mismatch and the clerk cannot process your application.

Update Social Security first (Form SS-5, no fee), then wait at least 48 hours for the federal database to synchronize before visiting the MVD.

Where to Go

You can update your license at any Montana Driver License Exam Station or an authorized third-party agent like MVD Express. The key difference: state-run exam stations charge only the base fee, while private providers add a convenience surcharge ranging from $20 to $50 on top.

Montana does not offer online name-change processing for driver's licenses — this must be done in person.

Documents to Bring

Pack all four items before leaving the house. Missing even one means a wasted trip:

1. Your current Montana driver's license (the one with your married name)
2. Your new Social Security card showing your restored name — or the official SSA receipt letter if the card hasn't arrived yet
3. A certified copy of your divorce decree with the Clerk of Court's raised seal, containing the name-restoration language
4. Two separate documents proving Montana residency — utility bills, bank statements, rental agreements, or mortgage statements showing your physical address (not a PO Box)

The two residency documents must come from different sources. Two utility bills from the same provider won't satisfy the requirement.

Fees

A standard duplicate driver's license costs $10.30. A REAL ID-compliant duplicate runs approximately $20.00. Payment methods vary by location — most exam stations accept checks and cards, but confirm ahead of time.

You'll receive a temporary paper license immediately. The permanent card arrives by mail in 10 to 14 business days.

REAL ID Considerations

If your current license is REAL ID-compliant and you want to maintain that status, you'll need to bring additional documentation. REAL ID requirements include proof of identity (the decree satisfies this), proof of Social Security number (your new card), and two proofs of Montana residency.

If you don't need REAL ID (for example, you have a valid passport for federal purposes), a standard replacement is simpler and cheaper.

What If You've Also Moved?

If you've changed your address since the divorce — which is common — update both your name and address in the same visit. The same fee applies whether you're changing one item or both. Bring residency documents showing your new address.

Under Montana law, you're required to notify the MVD within 10 days of any name change. Don't let this slip — it's one of those deadlines that can create problems if you need your license for a time-sensitive transaction like closing on a home refinance.
