Update Auto and Homeowners Insurance After Divorce in New Jersey
Don't Wait for the Title Transfer
Most people think about insurance only after they've transferred the car title or recorded the quitclaim deed. But insurance changes should happen at or before those transfers, not after. Driving a vehicle titled to you while the policy still lists your ex-spouse as the primary insured — or living in a home you now own while the homeowners policy is in your ex's name — creates coverage gaps that could leave you unprotected in a claim.
Auto Insurance
Contact your insurance provider as soon as the divorce is finalized. You'll need to:
- Remove your ex-spouse as a named insured or driver on the policy (or split into two separate policies if you shared one)
- Update the named insured to match the vehicle's new title holder
- Review and adjust coverage levels — your premiums may change based on single-driver status, removal of a multi-car discount, or a change in primary garaging address
If your ex-spouse is keeping a vehicle that was on your joint policy, they need their own separate policy before being removed from yours. Provide your insurer with a copy of the divorce decree showing the vehicle allocation.
New Jersey requires auto insurance, including liability coverage and Personal Injury Protection (PIP). Confirm the applicable liability and PIP limits with your insurer before removing anyone from a shared one.
Homeowners Insurance
If one spouse is keeping the family home, the homeowners insurance policy needs to reflect the new sole owner. Contact your insurer to:
- Change the named insured from both spouses to the retaining spouse only
- Update the mailing address if the departing spouse was the policyholder
- Review coverage amounts — if you're refinancing the mortgage as part of the divorce, the new lender may require specific coverage levels or a new policy
If you're the departing spouse moving to a rental, you'll need a renter's insurance policy to cover your personal property in the new residence. Your former homeowners policy may not provide the coverage you need for belongings at a different address.

Timing Matters for Mortgage Refinancing
If you're refinancing the home into your sole name, the new lender will require proof of homeowners insurance listing them as the loss payee. Coordinate the insurance update with the refinance closing — the lender needs the new policy before funding the loan.
