What the Free Simple Divorce Packet Actually Contains

Several South Carolina counties — including Spartanburg, Anderson, Pickens, Horry, and Saluda — offer free self-represented litigant divorce packets through their Clerk of Court offices. These packets include the basic forms needed to file an uncontested, no-fault divorce:

• SCCA 467 (Family Court Cover Sheet)
• SCCA 400.01 (Summons)
• SCCA 400.02 (Complaint for Divorce)
• SCCA 400.03 (Acceptance of Service — if the defendant agrees to waive formal service)
• SCCA 400.10 (Final Order of Divorce)
• SCCA 430 (Financial Declaration)
• Instructions for completing and filing the forms

The packet also includes the DHEC 0682 form for reporting the divorce to Vital Records. Filing costs $150 statewide, before any local or additional charges.

Who Can Actually Use It

The packet instructions are explicit: the simple divorce packet is designed only for couples who meet all of these conditions:

Both parties have already agreed on everything. Property division, debt allocation, spousal support (or waiver of it), and — if children are involved — custody and child support. The court forms don't include any negotiation tools, compromise frameworks, or settlement worksheets. They assume the deal is already done.

The divorce is based on one year of living separate and apart. The no-fault ground. The simple packet is not designed for fault-based filings (adultery, physical cruelty, habitual drunkenness, or desertion), which require different pleading language and evidentiary standards.

Neither party has complex financial issues. The packets contain no guidance on equitable apportionment, QDRO preparation for retirement accounts, business valuation, separate property tracing, or marital debt allocation beyond the most basic scenarios.

What It Doesn't Cover

This is where the simple divorce packet stops being useful for most real-world situations:

Financial Declaration preparation. The SCCA 430 form is included, but the packet provides no guidance on how to calculate monthly expenses, convert irregular income to monthly amounts, or handle common errors like double-counting escrowed taxes. Mistakes on the 430 are filed under oath — inaccuracies damage your credibility if the case becomes contested.

Property division strategy. If you own a home, have retirement accounts, run a business, or carry significant debt, the simple packet gives you no tools to determine a fair division. South Carolina's equitable apportionment statute (§ 20-3-620) requires weighing 15 factors — the packet doesn't reference them.

Spousal support analysis. The five forms of alimony in South Carolina each have different modification rules, termination triggers, and tax implications. The simple packet includes a checkbox for whether alimony is requested — it doesn't help you evaluate which type is appropriate or what amount is reasonable.

Retirement account division. Splitting a 401(k) or pension requires a Qualified Domestic Relations Order (QDRO) or, for PEBA state retirement systems, a specialized DRO under S.C. Code § 9-18-10. The simple packet doesn't include these forms or explain the process.

The Gap Between the Packet and a Complete Divorce

The simple divorce packet handles the procedural shell — the forms the clerk needs to process your case. But the substantive questions — how do we divide the house, what happens to the credit card debt, should we split the retirement accounts, does either party qualify for alimony — require analysis that the packet doesn't provide and court staff are legally prohibited from offering.

This is the gap that trips up self-represented litigants. They download the packet thinking it covers the whole process, then realize mid-filing that they need a comprehensive settlement agreement before any of the forms can be properly completed.
