Refinancing Home Loan After Divorce Singapore

The Court Order Must Come First

Banks will generally need a certified copy of the final court order before approving a mortgage refinancing from joint names to a single borrower. The ancillary matters order specifies who retains the property and on what terms.

Don't approach banks with an Interim Judgment. It doesn't finalize the property arrangements, and lenders will ask you to come back after the Certificate of Final Judgment is issued.

HDB Loans vs Bank Loans

If your existing mortgage is an HDB concessionary loan, you have a specific constraint: HDB does not grant loans for court-ordered buyout sums. If the court orders you to buy out your ex-spouse's share, you must fund the buyout through:

  • Your own CPF savings (Ordinary Account)
  • A commercial bank loan (refinancing from HDB loan to a bank mortgage)
  • Cash

Switching from an HDB loan to a bank loan changes your interest rate from the concessionary rate to a market rate — which can be higher or lower depending on current conditions. Check the current rates before committing.

If your existing mortgage is already a bank loan, the refinancing process is more straightforward: you're applying to take over the joint loan as a sole borrower.

What Banks Assess

When you apply to refinance as a single borrower, banks evaluate:

Total Debt Servicing Ratio (TDSR): Banks apply a total-debt-servicing limit to the borrower's gross monthly income, including the refinanced mortgage and other debts. After divorce, the bank will assess the proposed sole borrower under its current rules and criteria.

Mortgage Servicing Ratio (MSR): For relevant HDB flats and Executive Condominiums, an MSR limit may also apply. Confirm the current threshold with the lender or HDB.

Income documentation: Banks typically require your latest 3 months of payslips, latest Notice of Assessment from IRAS, and CPF contribution statements. Self-employed borrowers need 2 years of tax returns.

Property valuation: The bank arranges a fresh valuation. If property values have dropped since the original purchase, your loan-to-value ratio changes — potentially requiring a larger cash or CPF top-up.

CPF Refund Obligations

When one spouse transfers their share of an HDB flat to the other, any CPF monies used for the flat must be refunded as part of the transfer. Confirm the required housing refund amount and process with CPF/HDB.

For the retaining spouse, confirm with CPF/HDB how the transfer affects the CPF amounts tied to the flat and any future refund obligation.

If you're using CPF to fund part of the buyout, confirm your Ordinary Account balance can cover both the buyout amount and the ongoing mortgage deductions.

Timing the Refinancing

The ideal sequence:

  1. Obtain the Certificate of Final Judgment
  2. Get bank pre-approval for the refinanced mortgage (some banks offer conditional approval while the divorce is pending)
  3. Execute the HDB ownership transfer (or SLA title transfer for private property)
  4. Complete the refinancing — the bank discharges the old joint mortgage and registers the new individual one

The timing depends on the bank, HDB, and whether you are switching from an HDB loan to a bank loan; the HDB loan redemption involves a separate administrative process.

Stamp Duty Considerations

The spouse acquiring the other's share pays stamp duty on the transferred portion. In some cases, the court may grant stamp duty remission for divorce-related property transfers — check whether your court order addresses this, and verify with IRAS whether a remission applies to your specific situation.

For private property, Additional Buyer's Stamp Duty (ABSD) rules apply depending on citizenship and existing property ownership. If the retaining spouse already owns other property, ABSD could significantly increase the cost of the transfer.

Don't Trigger Refinancing Before the Court Order

Finalizing a mortgage transfer or other restructuring before the final court order is issued can be flagged as an unauthorized adjustment to the matrimonial asset pool. Complete the legal process first, then handle the banking side.
