Quebec Divorce Papers and Forms: What You Actually Need to File

You can download every official Quebec divorce form for free from the government portal. The problem isn't access — it's knowing which forms apply to your situation, what order they go in, and what supporting documents the court clerk will reject your package without.

The Core Filing Documents

Every Quebec divorce requires these regardless of pathway:

Originating Application — The formal document that starts your divorce case. Joint applications use a specific format generated through JuridiQC. Sole applications require a separately drafted Originating Application filed with a Summons (Avis d'assignation).

Sworn Declaration (Form SJ-765) — An affidavit confirming the facts of your marriage, separation, and grounds for divorce. This must be sworn before a Commissioner of Oaths — the court will not accept an unsigned or unsworn version.

Certified Marriage Certificate — Not a photocopy, not the decorative certificate from your wedding. You need an official certified copy from the Directeur de l'etat civil, which costs $34 to $66 depending on processing speed.

Certified Birth Certificates — For both spouses and all children of the marriage. Same source, same cost range.

Financial Disclosure: Form III

If either spouse is claiming spousal support, child support, or property division — which is nearly every divorce — both parties must complete Form III (Statement of Income and Expenditures and Balance Sheet). This is the form that trips up self-represented filers most often.

Form III requires a detailed accounting of monthly income, expenses, assets, and debts. You must attach your federal and provincial tax returns and Notices of Assessment for the past three years. Mathematical errors, missing categories, or incomplete attachments give the court registry grounds to reject your filing.

Joint Application vs. Sole Application Packages

Joint filing package includes the joint application, draft agreement (projet d'accord) covering custody, support, and property, sworn declarations from both spouses, all certificates, and Form III if applicable. Total court fee: CAD $241 plus $10 federal registry.

Sole filing package includes the Originating Application, Summons, your sworn declaration, all certificates, Form III, and after service, the bailiff's Certificate of Service (proces-verbal de signification). Total court fee: CAD $362 plus $10 federal registry.

Property Division Documents

Quebec's dual property system means you may need additional paperwork:

Simulated Partition from Retraite Quebec — If either spouse has QPP credits or an employer pension, you must request this official valuation before the court will accept your draft agreement. Without it, the registry rejects the filing.

Family Patrimony Inventory — A listing of all patrimony assets (family residences, household furniture, vehicles, pension plans, and RRSPs) with net market values calculated as of the filing date.

Matrimonial Regime Documentation — If you married under the default Partnership of Acquests, you need to classify each asset as private property or an acquest. If you have a notarized marriage contract establishing Separation as to Property, you'll need a copy.
