Divorce Filing Checklist for Saskatchewan: Documents You Need

The Court of King's Bench will not process an incomplete divorce application. Missing a single form, forgetting to attach your marriage certificate, or filing without your PAS completion record sends your entire file back — and you lose weeks waiting for another review slot.

Here is every document you need, in the order you will need them, for an uncontested divorce in Saskatchewan.

Before You File

Certified Marriage Certificate: Order from eHealth Saskatchewan (CA$30) if you do not have a certified copy. A church certificate, wedding program, or photocopy will not be accepted. The certified copy must be the original government-issued document. Processing takes 2 to 4 weeks, so order early.

Separation Agreement (if applicable): Not legally required to file for divorce, but if you and your spouse have negotiated terms for property, support, or parenting, the signed agreement becomes an exhibit attached to your Petition. A clear separation agreement dramatically simplifies the desk review.

Filing Documents (Joint Petition)

• Petition for Divorce (Form 15-16 or Form 15-100A) — signed by both co-petitioners
• Certified Marriage Certificate (original)
• Financial Statement (Form 15-47) — required if child support or spousal support is requested. Must include three years of Income Tax Returns and CRA Notices of Assessment
• Waiver of Financial or Property Statements (Form 15-48A) — available only for joint petitions with no children and no financial claims
• Registration of Divorce Proceedings — completed by the registry for the Central Registry in Ottawa

Filing Documents (Sole Petition)

• Petition for Divorce (Form 15-16) — signed by the petitioner
• Certified Marriage Certificate (original)
• Financial Statement (Form 15-47) — if support is claimed

After Service (Sole Petition Only)

• Affidavit of Personal Service (Form 15-12A) — completed and signed by the person who served the respondent, sworn before a Commissioner for Oaths
• OR Affidavit of Service by Alternate Mode (Form 15-8B) — if service was by mail with signed acknowledgment
• Note for Default — filed after the 30-day response window expires without an Answer

Program Certificates

Parenting After Separation (PAS) Certificate of Attendance: Required for both parents if the divorce involves minor children. The free PAS course takes 3 to 4 hours. Certificates must be filed with the court registry before the Application for Judgment. Each certificate is valid for two years from the date of attendance.

FDR Certificate of Participation: Required only if issues are contested. Filed after completing mediation, arbitration, collaborative law, or parenting coordination with a Ministry-approved provider.

Application for Judgment Package

This is the final package you submit requesting the judge to sign the Divorce Judgment:

• Application for Judgment (Form 15-76A)
• Affidavit of Petitioner (Form 15-78) — sworn before a Commissioner for Oaths, confirming all facts stated in the Petition
• Draft Divorce Judgment (Form 15-102) — prepared by you for the judge to review and sign
• Child Support Compliance materials — if children are involved, evidence that proposed child support meets the Federal Child Support Guidelines (or a written explanation of why it deviates)
• All previously filed documents, affidavits, and certificates must already be on the court file

The Clearance Certificate

You do not file this yourself. When you submit the Application for Judgment, the Saskatchewan registry automatically sends your case details to the Central Registry of Divorce Proceedings in Ottawa. This federal check confirms no other divorce action is pending between you and your spouse anywhere in Canada. The clearance takes 4 to 8 weeks and must come back clean before the judge will review your file.

If another action is pending — say your spouse filed in British Columbia without telling you — the Saskatchewan court will defer until that matter is resolved.

Common Mistakes

• Filing without the certified marriage certificate — a photocopy or church certificate is not accepted
• Submitting an Affidavit of Service without the street address or exact date — the registry rejects vague service proof
• Missing the PAS certificate — the court will not process your Application for Judgment without it
• Child support below the Guidelines table amount without a detailed written justification — judges are legally required to ensure adequate child support
• Unsigned affidavits — every affidavit must be commissioned (signed before a Commissioner for Oaths)
