Property Transfer After Divorce Victoria

The 12-Month Clock

From the date your divorce order takes effect — normally one month and one day after the hearing, unless the Court makes a special order changing that timing — you have exactly 12 months to commence property settlement proceedings under the Family Law Act 1975. This deadline applies to all property matters, including real estate transfers.

If you miss this window, you need to apply for special leave from the Federal Circuit and Family Court. The court grants special leave only in limited circumstances — typically where hardship to a party or child of the marriage is demonstrated — and it's not guaranteed. Start the process well before month 12.

The Three Steps to Transfer

Property transfers in Victoria involve three coordinated steps that must happen in sequence:

1. Formalise the agreement. The transfer must be authorised by either Consent Orders (filed with the court at $215) or a Binding Financial Agreement. An informal agreement — even one drafted by solicitors — doesn't qualify for the stamp duty exemption and can't compel a reluctant party to comply.

2. Claim the stamp duty exemption. Submit the Digital Duties Form through the SRO's Duties Online portal before settlement. Section 44 of the Duties Act 2000 (Vic) exempts transfers arising from relationship breakdown from land transfer duty entirely. Without it, you'd pay between 1.4% and 6.5% of the property's market value in stamp duty.

3. Settle through PEXA. The change of ownership is registered with Land Services Victoria through the PEXA electronic settlement platform. Your conveyancer lodges the transfer, coordinates the mortgage discharge and new mortgage registration (if applicable), and links the SRO exemption to the transaction.

What It Costs (Even With No Stamp Duty)

The stamp duty exemption removes the largest potential cost, but the transfer still carries statutory and platform fees:

CGT Rollover Relief

At the federal level, Division 126 of the Income Tax Assessment Act 1997 provides mandatory CGT rollover relief for property transfers under a court order or BFA. The transferring spouse disregards any capital gain or loss at the time of transfer — but the relief is a deferral, not an elimination.

The receiving spouse inherits the original cost base of the property, including the date of acquisition. When they eventually sell, they're liable for all the CGT that has accrued since the property was first purchased. If the property has appreciated significantly during the marriage, this deferred tax liability can be substantial and should be factored into the settlement negotiations.

The family home is usually protected by the main residence exemption, which shields it from CGT provided it was used as the principal place of residence. But if the property was rented out at any point (subject to the six-year absence rule) or used for business, a partial CGT liability applies.

If the Property Must Be Sold

When neither party can refinance the joint mortgage into their sole name — either because individual borrowing capacity is insufficient or Lenders Mortgage Insurance costs are prohibitive — selling on the open market and dividing the net proceeds is the standard fallback.

The sale proceeds are divided according to the Consent Orders or BFA. The conveyancer handles the distribution at settlement, clearing the mortgage, paying agent commissions, and splitting the remaining equity as directed by the agreement.
