Why a Court Order Isn't Enough
A family court property order says who gets the house. The bank that holds the mortgage isn't bound by it.
Under Australian lending law, a joint mortgage is "joint and several" — meaning the lender can pursue either borrower for the full outstanding debt regardless of what a court order or Binding Financial Agreement says about who's responsible. Until the joint mortgage is formally discharged and replaced with a sole mortgage in one name, both parties are on the hook.
The only way to get the outgoing partner's name off the mortgage is a full refinance into the retaining partner's sole name.
The Refinance Process
The person keeping the property must apply for a new mortgage as a sole borrower. The bank treats this as a fresh application — they assess the retaining partner's individual income, expenses, existing debts, and borrowing capacity as though the joint mortgage never existed.
If the new loan amount exceeds 80% of the property's appraised value, the bank will require Lenders Mortgage Insurance (LMI). This can add thousands to the refinancing costs and should be factored into the property settlement negotiations.
If the retaining partner can't qualify for a sole mortgage — because their income alone is insufficient or LMI costs are prohibitive — the parties may have no option but to sell the property on the open market and split the net proceeds.
Some conveyancers arrange a "simultaneous settlement," where the outgoing partner uses their share of the equity payout directly as a deposit on a new property on the same day. This avoids the gap between losing equity and finding a new home.
Transferring the Title
Once the refinance is approved, the change of ownership is registered with Land Services Victoria through the PEXA electronic settlement platform. Your conveyancer or solicitor handles the lodgement, which typically involves:
- Discharge of the old joint mortgage — $119 registration fee with Land Services Victoria
- Registration of the new sole mortgage — $119
- Transfer of Land registration — $119 to $250 depending on the property's value
- PEXA platform fee — $110 to $130 per party
- Title search — $30 to $80 to confirm the current proprietors and any encumbrances
- Water and council rate certificates — $20 to $70 each
Total statutory and platform costs typically run $700 to $1,200 even when stamp duty is fully exempted.

Claiming the Stamp Duty Exemption
Section 44 of the Duties Act 2000 (Vic) exempts the transfer from land transfer duty provided:
- The transfer results from a marriage or de facto relationship breakdown
- The parties have formalised their arrangement in Consent Orders or a Binding Financial Agreement (informal agreements don't qualify)
- No third party acquires an interest in the property
You claim the exemption by submitting the Digital Duties Form through the SRO's Duties Online portal before settlement. The form is linked to the PEXA lodgement so the transfer and the exemption claim happen in a coordinated sequence.
Without the exemption, standard Victorian land transfer duty on an $800,000 property would be approximately $43,070.
The 12-Month Deadline
Property settlement proceedings must be filed within 12 months of the divorce order taking effect. If the refinance and transfer take longer than expected — which happens when borrowing capacity is marginal or when the property market makes refinancing difficult — make sure formal proceedings are at least commenced within that window to preserve your rights.
