Oklahoma Divorce Papers and Forms: What You Need to File

Oklahoma Divorce Papers and Forms: What You Need to File

Oklahoma is one of the states that does not supply a standardized divorce packet. There is no single "Oklahoma divorce kit" you can download, fill out, and hand to a clerk. Instead, you assemble your own set of documents, and each of the 77 county district courts can have slightly different copy requirements and local form preferences.

The forms themselves are free — the challenge is knowing which ones you need, where to get them, and how to submit them without a clerk rejection.

Where to Get Free Oklahoma Divorce Forms

Three legitimate free sources provide the documents you need:

  • OSCN.net (Oklahoma State Courts Network) — The official judicial repository. Contains appellate forms and some district court templates under Rule 1.301.
  • OKLaw.org (Legal Aid Services of Oklahoma) — Provides interactive divorce documents and guides for low-income residents. Income screening may apply for full services, but the forms themselves are accessible.
  • County district court websites — Cleveland County, Tulsa County, and Oklahoma County each publish downloadable forms specific to their court's requirements.

Avoid paying for forms on third-party sites. Every document you need is available at no cost from these sources.

The Core Documents You Need

The exact set depends on whether minor children are involved, but the typical filing packet includes:

For every divorce:

  • Petition for Dissolution of Marriage — Initiates the case. You must select the correct version (with or without minor children).
  • Summons — Formally commands the respondent to answer within 20 days of service.
  • Civil Cover Sheet (AOC-CCS-2017) — Required to index the case in the court system.
  • Automatic Temporary Injunction (ATI) Notice — Mandated by 43 O.S. § 110. Notifies both parties that marital assets and parental arrangements are frozen upon service.

When minor children are involved, add:

  • DHS Child Support Computation Form (03EN025E) and Insurance Premium Worksheet (03EN027)
  • Parenting Plan — Detailed custody schedule covering decision-making, parenting time, holiday rotation, and communication under 43 O.S. § 109.

For cooperative spouses:

  • Entry of Appearance and Waiver of Summons — Lets the respondent waive formal service. Critical rule: this waiver is void if signed the same day the petition is filed. The respondent must wait at least 24 hours after the official filing date.

For the final hearing:

  • Marital Settlement Agreement (if uncontested)
  • Decree of Dissolution of Marriage — The proposed final order for the judge to sign.

County Copy Rules That Cause Rejections

This is where most self-represented filers get tripped up. Having the right forms is not enough — you need the right number of copies in the format each clerk expects.

Oklahoma County, for example, requires three physical copies of every petition, waiver, and decree. Other counties may require two, or may accept only originals plus one certified copy. The Civil Cover Sheet must accompany every filing.

Call your county clerk's office before your filing day to confirm:

  • How many copies of each document they require
  • Whether they accept stapled or unstapled packets
  • Whether notarization must be done on-site or can be done beforehand
  • The exact filing fee and accepted payment methods

Forms Are Free — The Process Navigation Is What You Pay For

Blank forms do not tell you the sequence of steps, the timing rules, or the local clerk protocols. They do not explain that signing a waiver too early invalidates your case, or that under HB 2138, your spouse can lose their right to respond after just 20 days without a hearing.

The Oklahoma Divorce Filing Process Guide walks you through every step from document assembly to the prove-up hearing — not a replacement for the free forms, but the roadmap that makes them usable.
