Oklahoma does not have a single statewide divorce filing fee. Each of the 77 county district courts sets its own fee schedule, which includes the base court cost plus local surcharges for law library funds, court technology systems, and mediation assessments. The difference between counties can be $75 or more.

Here are the verified fees for the highest-volume divorce courts in Oklahoma, plus what else you will pay beyond the filing fee.

These fees are for filing the initial Petition for Dissolution of Marriage. Additional costs apply for specific motions, continuances, or certified copies.

Always call your county clerk before filing day. Surcharges change when counties adjust their local assessments, and some clerks accept only specific payment methods (cash, money order, or cashier's check — not all accept personal checks or credit cards).

Additional Costs Beyond the Filing Fee

The filing fee is not the only expense. A complete uncontested divorce in Oklahoma typically includes:

If both spouses cooperate, using the Entry of Appearance and Waiver eliminates the service cost entirely. The co-parenting class is mandatory only when minor children are involved (43 O.S. § 107.2).

How to Get the Filing Fee Waived

If you cannot afford the filing fee, you can submit a Pauper's Affidavit (Application to Proceed In Forma Pauperis) under 12 O.S. § 1009.1. You must disclose:

  • All sources of monthly income
  • Monthly expenses (rent, utilities, food, transportation, medical)
  • Bank account balances and assets
  • All debts
  • Any public benefits you receive (SNAP, TANF, SSI, Medicaid)

The clerk places the affidavit on the uncontested docket for a judge to review — typically the same day or within a few days. If approved, the filing fee and sheriff service fee are both waived.

One restriction under District Court Rule 21: you cannot file a Pauper's Affidavit if you have paid legal counsel. The waiver is for self-represented, low-income filers only.

With an approved waiver, total divorce costs can drop to roughly $30 — just the sliding-scale parenting class fee.

Why Fees Vary So Much Between Counties

Oklahoma's county fee structure includes several layered surcharges on top of the base court cost set by Title 28. Individual counties add:

  • Law library fees — Funds the county law library available to self-represented filers
  • Court technology fees — Supports the county's electronic filing and case management systems
  • Mediation fund assessments — Funds the court-connected Early Settlement Mediation program
  • Courthouse security fees — Some counties add a per-filing security surcharge

These surcharges are set by each county's court clerk and can change without statewide notice. Two counties with the same base fee can have final filing fees that differ by $50+ based on their surcharge schedule.

Choosing Your Filing County

You have two venue options under 43 O.S. § 103:

  1. Your county of residence — You must have lived there for at least 30 days before filing
  2. Your spouse's county of residence — No minimum residency period required for you

If fees differ significantly between the two counties, and both are convenient, the lower-fee county saves money. However, choosing a county solely for the fee savings means attending all hearings there — consider travel time and courthouse schedules.
