New York provides every uncontested divorce form for free through the Unified Court System website. The problem isn't access — it's sequence. Downloading 30+ PDFs with no roadmap leads to the kind of errors that get packets rejected by Supreme Court clerks.

Here's every form you'll encounter, in the order you'll actually need them.

Phase 1: Commencement Forms

These forms initiate the divorce and must be filed with the County Clerk when you purchase your index number ($210).

UD-1 Summons with Notice Notifies defendant of the action and lists the relief sought
UD-1a Summons Used when filing with a Verified Complaint instead of a Summons with Notice
UD-2 Verified Complaint Detailed pleading stating grounds, residency, and requested relief

You choose either UD-1 (Summons with Notice) or UD-1a + UD-2 (Summons with Verified Complaint). Both routes work for uncontested cases. The Summons with Notice is simpler — a single form that lists the relief you're seeking without a full narrative.

Also required at commencement: Notice of Automatic Orders (DRL 236-B), Notice Concerning Continuation of Health Care Coverage, and Notice of Guideline Maintenance. If you have minor children, attach the Child Support Standards Chart.

Phase 2: Service Forms

Form Name Purpose
UD-3 Affirmation of Service Proves the defendant was properly served — includes date, time, location, physical description, perceived race and gender

The person who serves your spouse (not you — a non-party aged 18+) completes UD-3. Under Chapter 473 of the Laws of 2024, the server must record the defendant's perceived race and gender. Missing this gets the form rejected.

Phase 3: Defendant Response

UD-7 Sworn Affirmation of Defendant Defendant consents to the divorce and waives all waiting periods

If your spouse signs UD-7, you can skip the 40-day default waiting period and proceed directly to Phase 4. Critical timing rule: UD-7 must be signed after the Summons is filed and assigned an index number. If your spouse signs it before filing, clerks will reject the entire packet.

Phase 4: The Uncontested Divorce Packet

These forms go to the court together once the response window closes or consent is obtained.

Common Form Mistakes That Trigger Clerk Rejections

  • UD-7 signed before the index number is purchased — the entire packet gets rejected
  • Name inconsistencies across forms — "Mary Smith" on the Summons but "Mary Drew Smith" on the Complaint
  • Double-sided printing — New York courts require all documents printed single-sided on white paper in black ink
  • Requesting relief in UD-6 that wasn't listed on UD-1 — the Plaintiff's Affidavit can only include relief that matches the original Summons
  • Handwritten corrections on notarized documents — any changes made after notarization require the entire form to be redrawn, re-signed, and re-notarized
