How to Remove Your Ex from a Mortgage After Divorce in Wisconsin

A quitclaim deed removes your ex-spouse from the title to your home. It does not remove them from the mortgage. These are two separate legal instruments, and confusing them is one of the most expensive mistakes people make after a Wisconsin divorce.

Ownership (the deed) and debt (the mortgage) are independent. Your divorce decree may award the house to you and order your ex to sign a quitclaim deed transferring their ownership interest. But the mortgage lender was not a party to your divorce. As far as the bank is concerned, both names on the original promissory note are still jointly liable for every payment. If you stop paying, the lender can pursue your ex — and if your ex stops paying on a debt the decree assigned to them, the lender can pursue you.

Option 1: Refinance into Your Name Alone

Refinancing is the cleanest solution. You apply for a new mortgage as the sole borrower, the new loan pays off the old joint loan, and the old loan is discharged. Your ex is fully released from the debt.

The catch: you must qualify for the new loan on your own income and credit score. If you relied on your ex's income to qualify for the original mortgage, this may not be possible. Some marital settlement agreements include a refinance deadline — for example, 90 to 120 days after the divorce. If you cannot refinance by that date, the decree may require you to sell the house and split the proceeds.

Option 2: Loan Assumption

Some mortgage contracts include an assumption clause that allows a qualified borrower to take over the existing loan terms. Loan assumptions avoid the closing costs and potential rate increase of a full refinance. Contact your lender to ask whether your mortgage is assumable and what their qualification requirements are. FHA and VA loans are generally assumable; most conventional loans are not.

Option 3: Lender Release of Liability

A few lenders will release one borrower from a joint mortgage without requiring a refinance, typically if the remaining borrower can demonstrate sufficient income and a strong payment history. This is rare and lender-dependent, but worth asking about — especially if current interest rates are significantly higher than your existing rate.

Recording the Quitclaim Deed

Regardless of which mortgage path you choose, the ownership transfer itself must be recorded with the county Register of Deeds, typically by quitclaim deed or Form FA-4135V (Abridgement Affecting Title to Real Estate). In Wisconsin, the transfer also requires filing an electronic Real Estate Transfer Return (eRETR) through the Department of Revenue portal. The transfer between ex-spouses pursuant to a divorce decree is exempt from the state transfer fee under Wis. Stat. § 77.25(8m), but you must still complete the eRETR; if you use a quitclaim deed, cite the exemption on the face of the deed.

If you use a quitclaim deed, it must be signed by the conveying spouse and notarized (or authenticated by a member of the State Bar of Wisconsin). A flat recording fee of $30.00 applies at the Register of Deeds office.

Do not delay recording. If you wait and later transfer the property outside the immediate scope of the divorce decree, the exemption under § 77.25(8m) may no longer apply. The transfer fee would then be assessed based on the property's market value at the time of the late transfer.

What If Your Ex Won't Cooperate?

If your ex-spouse refuses to sign the quitclaim deed despite being ordered to do so in the divorce judgment, you can file a motion for contempt with the circuit court. The court can order compliance and impose sanctions, including fines and jail time for willful refusal.
