Using Your Divorce Decree as a Name Change Order

If the judge included your name restoration in Section 4 of the Final Divorce Order (Form FL Divorce 241), you already have a legal name change order. You don't need to petition district court or pay separate filing fees — the certified decree is your name change document.

If Section 4 was left blank or marked "Neither spouse asked to change their name," you'll need a separate name change petition through district court, which costs $260 to $307 depending on the county.

The distinction matters because it controls whether you spend $0 or $300+ just to get started.

The Mandatory Sequence: Federal First, Then State

Washington's Department of Licensing won't update your driver's license until the Social Security Administration has processed your name change. The SSA database is the master record that state agencies verify against. Skip this step and the DOL system will reject your update.

Step 1: Social Security Administration (free)

File Form SS-5 at your local SSA office or by mail. Bring your certified divorce decree and a current government-issued photo ID. There's no fee. Your new card arrives in 10–14 business days; allow the SSA record to update before visiting DOL.

Step 2: Washington Department of Licensing (wait 24–48 hours after SSA)

Visit a DOL office in person or use License eXpress online. Bring your certified decree and current license. A standard license update costs $20. An Enhanced Driver's License or Enhanced ID runs $103–$137.

One trap: DOL won't change your middle name (like replacing your middle name with your maiden name) unless the divorce decree specifies that exact configuration — or you've already updated your U.S. passport to show the new middle name.

Step 3: U.S. Passport

Which form you file depends on when your current passport was issued. If it was issued within the past year, use Form DS-5504 (free for standard processing). More than a year ago, use DS-82 ($130 renewal). If you can't renew by mail, DS-11 costs $130 plus a $35 execution fee. Include your certified decree and a new passport photo.

Step 4: Everything else

Once SSA, DOL, and passport are updated, work through the rest — employer payroll, banks, credit cards, health insurance, professional licenses, voter registration, utilities, and your Good To Go! toll account. Each agency needs a certified copy of your divorce decree, so order at least five from the Superior Court clerk ($5–$20 per copy depending on the county).

Professional Licenses and State Boards

If you hold a Washington professional license — nursing, teaching, law, real estate — notify your licensing board. The Department of Health, the Office of Superintendent of Public Instruction, and the Washington State Bar Association all require a certified decree copy and a name update form. A mismatch between your license name and your legal name can trigger compliance flags.

How Long the Full Process Takes

Realistically, four to six weeks from start to finish. The SSA update takes the longest — about two weeks for the card, though the database updates faster. The DOL update can happen the same week if you go in person. Banks and credit cards usually process changes in one to two business days once you provide documentation.
