Health Insurance After Divorce in Washington

Why Divorce Creates a Coverage Gap

If you were covered under your spouse's employer health plan, your coverage ends when the divorce is finalized. You're no longer a qualifying dependent. Most employers remove the ex-spouse from the plan within 30 days of notification, and some retroactively terminate coverage to the date of the decree.

This is rarely something people plan for during the divorce process itself. But acting within the first week after finalization determines whether you have continuous coverage or a potentially dangerous gap.

Option 1: COBRA Continuation Coverage

COBRA lets you stay on your ex-spouse's employer plan for up to 36 months after a divorce (divorce qualifies as a "qualifying event" for 36-month coverage, not the standard 18 months for job loss). The coverage is identical — same doctors, same network, same prescriptions.

The catch is cost. Under COBRA, you pay 102% of the total premium — your share plus the employer's previous contribution plus a 2% administrative fee. For a family plan, this often runs $1,500–$2,200 per month. For individual coverage, $500–$900 per month.

The 60-day notification deadline is strict. Once the divorce is finalized, the covered employee (your ex-spouse) or you must notify the plan administrator in writing within 60 days. The plan then has 14 days to send you the COBRA election notice, and you have 60 days from that notice to elect coverage. Missing the initial notification deadline eliminates the option entirely.

Option 2: PEBB and SEBB Continuation (State Employees)

If your ex-spouse is a Washington state employee, their coverage runs through the Public Employees Benefits Board (PEBB) or the School Employees Benefits Board (SEBB). These programs offer their own continuation coverage with the same 60-day notification deadline.

PEBB and SEBB continuation works similarly to COBRA — you pay the full premium plus an administrative surcharge. The premium depends on the specific plan and coverage level. Contact the Health Care Authority to confirm rates and enrollment procedures.

Option 3: Washington Healthplanfinder (Special Enrollment)

Divorce-related loss of coverage qualifies you for a Special Enrollment Period (SEP) on Washington Healthplanfinder, the state's health insurance marketplace. You have 60 days from the qualifying event — usually the loss of coverage connected to the divorce — to enroll in an individual or family plan.

Healthplanfinder plans range from catastrophic-level coverage to comprehensive platinum plans. Depending on your income, you may qualify for premium tax credits (subsidies) that substantially reduce your monthly cost. For many people, a marketplace plan with subsidies is far cheaper than COBRA — sometimes by $800 or more per month.

To enroll, visit wahealthplanfinder.org and report your divorce as a qualifying life event. You'll need your final decree and proof of prior coverage.

Option 4: Employer Coverage Through Your Own Job

If you have access to your own employer-sponsored health plan, divorce triggers a Special Enrollment Period at your workplace too. You typically have 30 days from the loss of coverage to enroll. Contact your HR department immediately after finalization — don't wait for COBRA paperwork to arrive.

Which Option Should You Choose?

If cost is the primary concern and you qualify for subsidies, Washington Healthplanfinder almost always wins over COBRA. If you're mid-treatment with a specialist who's in-network on your ex-spouse's plan and out-of-network everywhere else, COBRA's identical coverage may be worth the premium for continuity.

Whatever you choose, don't miss the 60-day windows. Once they close, you're waiting until the next open enrollment period — potentially months without coverage.
