The Mandatory Holding Period

Once the Family Court enters the Final Judgment, the non-employee spouse's coverage eligibility ends. This triggers a qualifying life event — a narrow window to make health insurance changes outside the annual open enrollment period.

The 31-Day Deadline

The employee spouse has exactly 31 days from the date the Final Judgment is entered to:

  • Notify their employer's HR department of the divorce
  • Remove the ex-spouse from the employer health plan
  • Adjust their own coverage level (family to individual, for example)

If you miss this 31-day window, your employer may not allow changes until the next open enrollment. You could be paying premiums for your ex for months.

Options for the Non-Employee Spouse

COBRA Continuation Coverage

If your ex-spouse's employer has 20 or more employees, you're entitled to continue the same health coverage through COBRA for up to 36 months. You must be notified of your COBRA rights within 14 days and have 60 days to elect coverage.

The catch: you pay the full premium (both the employee and employer portions) plus a 2% administrative surcharge. For many plans, this means $500 to $700+ per month for individual coverage.

HealthSource RI (State Exchange)

Rhode Island's health insurance marketplace offers individual and family plans with potential premium tax credits based on income. Divorce qualifies you for a 60-day special enrollment period.

Apply within 60 days of the Final Judgment entry date. You'll need your divorce decree and proof of lost coverage.

Employer Coverage

If you have your own employer-sponsored plan, the divorce is a qualifying life event that lets you enroll or change coverage within 30 days.

Medicaid

If your post-divorce income qualifies, Rhode Island Medicaid (managed through the state's RIte Care program) provides coverage with minimal or no premiums.
