Health Insurance After Divorce in New Mexico

If you were covered under your spouse's employer health plan, your coverage ends when the divorce is finalized — sometimes on the date of the decree, sometimes at the end of the month. Either way, you have a narrow window to secure new coverage, and missing the deadline locks you out until the next open enrollment period.

Your Three Options

1. Federal COBRA (Employers With 20+ Workers)

Under the Consolidated Omnibus Budget Reconciliation Act, divorce is a qualifying event that entitles the former spouse to continue on the same employer plan for up to 36 months.

The deadline: You have 60 days from the later of (a) the date coverage is lost or (b) the date you receive the COBRA election notice. Miss this window and the right is permanently forfeited.

The cost: You pay the full premium — the employee share plus the employer share — plus up to a 2% administrative fee. For a family plan that costs $1,800 per month in total, you could be looking at $1,836 per month out of pocket. There is no subsidy.

When it makes sense: COBRA is worth the cost if you are mid-treatment with a specific provider network, if you have a chronic condition and switching plans would disrupt continuity, or if you only need coverage for a few months while you transition to a new plan.

2. New Mexico Mini-COBRA (Employers With 2-19 Workers)

Under NMSA 1978 § 59A-18-16, New Mexico extends continuation coverage rights to employees of small businesses that are not covered by federal COBRA.

The deadline: 30 to 31 days from the date group coverage is lost. This is a significantly shorter window than federal COBRA.

The duration: Up to 6 months of continued coverage (compared to 36 months under federal COBRA).

The cost: Full premium plus administrative fees, similar to federal COBRA.

3. BeWellnm Marketplace (ACA Exchange)

Divorce is a Qualifying Life Event that triggers a 60-day Special Enrollment Period on New Mexico's state health insurance exchange, BeWellnm (bewellnm.com). This allows you to enroll in an individual or family marketplace plan outside of the annual open enrollment window.

The deadline: 60 days from the date of divorce.

The cost: Varies by plan tier (Bronze, Silver, Gold, Platinum) and your income. If your post-divorce household income falls between 100% and 400% of the federal poverty level, you may qualify for premium tax credits that significantly reduce your monthly cost. If your income is below 200% FPL, you may also qualify for cost-sharing reductions on a Silver plan.

When it makes sense: For most people losing spousal coverage, the marketplace is the best long-term option. COBRA preserves your current network but at full price. A marketplace Silver plan with subsidies can cost a fraction of COBRA while providing comparable coverage.

How to Decide

Compare costs immediately. Do not default to COBRA because it is familiar. Run the numbers:

  • Get your COBRA premium quote from the employer's HR department
  • Check your marketplace premium estimate at bewellnm.com (you will need your projected post-divorce income)
  • Compare networks — verify that your current doctors accept marketplace plans in your area

Consider the coverage gap. COBRA coverage is retroactive to the date of loss, so if you elect COBRA within the 60-day window, there is no gap. Marketplace coverage starts on the first of the month following enrollment. If timing matters — for example, you have a scheduled procedure — COBRA bridges the gap.

  • Proof of the qualifying life event (certified copy of your divorce decree)
  • Your Social Security number
  • Immigration documents (if applicable)
