Filing for Divorce in Alaska Without a Lawyer

Most Uncontested Alaska Divorces Don't Need an Attorney

If you and your spouse agree on property division, debts, and custody (if applicable), you can handle your own filing from start to finish. Alaska's court system provides every form you need for free at courts.alaska.gov/shc/family/forms.htm, and the $250 filing fee is the mandatory court filing cost. Divorce-track cases may also involve service costs.

The dissolution track is especially manageable on your own — both spouses sign the petition together, there's no service of process, and cases typically wrap up in 30 to 60 days. Even the solo divorce track (Complaint for Divorce) is straightforward if your spouse cooperates after being served.

Free Court Resources for Self-Represented Filers

Alaska provides more self-help infrastructure than most states:

  • Family Law Self-Help Center — phone support at 907-264-0851 for procedural questions (they can't give legal advice, but they can clarify which forms you need and how the process works)
  • Free form packets — pre-assembled packets like DR-1 (dissolution with children), DR-2 (dissolution without children), SHC-PAC1A (divorce with children), and SHC-PAC1B (divorce without children)
  • TrueFiling e-filing portal — electronic submission so you don't have to visit the courthouse in person
  • Fee waivers — form TF-920 if you can't afford the $250 filing fee

Staff at the Self-Help Center are prohibited from recommending strategy or telling you what to put in your settlement agreement. They can point you to the right forms and explain deadlines, but the actual decision-making is yours.

The Common Pitfalls for Pro Se Filers

Most self-represented cases that stall do so because of administrative errors, not legal complexity:

Wrong form packet. Filing a dissolution petition when your spouse won't cooperate (or a divorce complaint when you actually agree on everything) creates unnecessary delays. Choose your track before downloading anything.

VS-401 mistakes. The Certificate of Divorce must be completed in black ink with zero corrections. Cross-outs, liquid paper, or a missing signature gets the entire packet bounced.

Service errors. If you're on the divorce track, service must follow Civil Rule 4 exactly — certified mail needs restricted delivery and return receipt, or you need a licensed process server. Casual delivery doesn't count.

Missing the 60-day window. Joint dissolution petitions expire 60 days after the first spouse signs. Miss this deadline and you start over with a fresh petition.

Skipping Rule 26.1 disclosures. In contested or unilateral divorce cases, both sides must exchange financial documents within 45 days of the Answer. Failing to comply can result in evidentiary sanctions at trial.

When You Should Consult an Attorney

Self-representation works well for simple cases, but certain situations involve risks that a filing guide can't mitigate:

  • Retirement accounts or pensions — splitting a 401(k), PERS, or TRS account requires a Qualified Domestic Relations Order (QDRO), and drafting errors can permanently forfeit benefits
  • Business ownership — valuing a family business for division goes beyond standard court forms
  • Out-of-state property — Alaska courts lack direct jurisdiction over real estate in other states
  • Domestic violence — if your safety is at risk, the joint dissolution track is inappropriate and you should work with a DV advocate to coordinate filings safely

For everything else, the Alaska Divorce Filing Process Guide gives you the step-by-step sequence from choosing your track through getting your final decree.
