Rhode Island Divorce Documents to Keep
You'll need your divorce documents for years — sometimes decades — after the case is closed. Banks, the SSA, the DMV, retirement plan administrators, and real estate title companies all require certified copies of specific documents. Losing them means delays and fees to replace them.
Here's what to keep and where to get copies when you need them.
Documents to Keep Permanently
Final Judgment of Divorce: The single most important document. Required for name changes (SSA, DMV), property transfers, QDRO filings, and health insurance enrollment. Keep multiple certified copies — at least three to five.
Decision Pending Entry of Final Judgment: Filed within 30 days of the nominal hearing. This establishes the divorce terms before the nisi period runs.
Marital Settlement Agreement (MSA): The detailed agreement covering property division, child custody, support obligations, and retirement account allocation. Plan administrators need this for IRA transfers.
Qualified Domestic Relations Order (QDRO) or Domestic Relations Order (DRO): If retirement accounts were divided, keep the signed order permanently. Plan administrators may request it years later.
Property Settlement Documents: Quitclaim deeds, vehicle transfer records, closing statements from refinancing.
Child Support and Alimony Orders: Keep original and any modifications. These stay relevant until the obligations terminate.
Where to Get Certified Copies
Family Court Clerk's Office
For cases less than three years old, certified copies are available from the Family Court clerk's office in the county where the divorce was filed. Fee: $25 per certified decree.
Judicial Records Center (JRC) in Pawtucket
Cases older than three years are archived at the Rhode Island Judicial Records Center, located in Pawtucket. The JRC is the centralized repository for all archived court records statewide.
Fees at the JRC:
- Certified copies of divorce decrees: $25
- Standard (uncertified) copies: $0.20 per page
You can request copies in person or by mail. Include the case number, the names of both parties, and the approximate date of the divorce to speed up the retrieval process.
How Many Certified Copies Do You Need?
Order at least three to five certified copies of the Final Judgment at the outset. You'll use them for:
- Social Security Administration (name change)
- Rhode Island DMV (license update)
- Municipal Land Evidence Office (quitclaim deed recording)
- Plan administrators (QDRO execution)
- Passport agency (name change)
- Banks and financial institutions
Institutions require original certified copies — photocopies are rejected for name changes and title transfers. Running out mid-process means another trip to the courthouse and another $25 per copy.
