How to Change Your Name on a Passport After Divorce
Updating your passport after a divorce name change isn't optional if you plan to travel internationally — your airline ticket must match your passport name exactly, and TSA won't board you if they don't match. The process depends entirely on how old your current passport is.
Before touching your passport, update your name with the Social Security Administration first. The State Department verifies passport applications against the SSA database, and a name mismatch triggers delays or rejection.
Three Scenarios Based on Passport Age
Passport Issued Less Than 1 Year Ago
File Form DS-5504 (Name Change, Data Correction, and Limited Passport Book Replacement). Mail it with your current passport, a certified copy of your divorce decree or name change order, and one new passport-compliant photo.
Cost: Free for standard processing. $60 for expedited processing. Processing time: 6-8 weeks standard, 2-3 weeks expedited.
Passport Issued 1 to 15 Years Ago
File Form DS-82 (Passport Renewal Application). Mail it with your current passport, certified divorce decree, a new photo, and the application fee.
Cost: $130 for a passport book. Processing time: 6-8 weeks standard, 2-3 weeks expedited (additional $60 fee).
Passport Issued More Than 15 Years Ago
You must apply in person at an authorized passport acceptance facility (many post offices, county clerks, and libraries serve as acceptance facilities). File Form DS-11 (Application for a U.S. Passport).
Bring your certified divorce decree, proof of identity, proof of citizenship (birth certificate or naturalization certificate), and a new photo.
Cost: $165 total — $130 application fee plus $35 execution fee. Processing time: 6-8 weeks standard, 2-3 weeks expedited.
What Counts as a Legal Name Change Document
The State Department accepts several types of documentation:
- A certified copy of your divorce decree that includes a name restoration order
- A certified court order specifically granting the name change
- In North Carolina, a certified Form AOC-SP-600 (Application/Notice of Resumption of Former Name) with the Clerk of Court's seal
Regular photocopies are not accepted. You need the version with the raised seal from the Clerk of Superior Court.
Passport Card vs. Passport Book
If you hold both a passport card and a passport book, you'll need to update each separately. The passport card (valid for land and sea travel to Canada, Mexico, the Caribbean, and Bermuda) has a lower renewal fee of $30.
