What Happens at a Case Management Conference in Maine

The Case Management Conference is the first major court event in any Maine custody case — and it's where many of the critical early decisions get made. Unlike a trial, this isn't about presenting your full case. It's an administrative hearing run by a Family Law Magistrate who manages your case from this point forward.

Understanding what happens at the CMC and what to bring determines whether you leave with favorable temporary orders or spend months trying to undo a bad starting position.

Who Runs It

Maine assigns specialized Family Law Magistrates to all domestic relations cases involving children, governed by Rule 110A. The magistrate isn't a judge — they're a judicial officer with specific authority over family cases. They manage discovery deadlines, enter temporary orders, and refer cases to mediation.

For uncontested cases where both parents agree on all issues, the magistrate can enter final orders. For contested cases, they set the procedural framework and manage the case until it's resolved through mediation or sent to a District Court Judge for trial.

What Happens During the Conference

The CMC typically covers:

Financial review. The magistrate examines both parents' Child Support Affidavits (FM-050) and Child Support Worksheets (FM-040). You must exchange completed worksheets with the other parent at least three days before the conference. Showing up without your paperwork in order makes a poor impression and can delay the process.

Temporary orders. The magistrate can issue binding interim orders for:

• Parent-child contact schedules during the case
• Which parent stays in the marital home
• Temporary child support based on the submitted worksheets
• Responsibility for marital debts while the case is pending

These temporary orders remain in effect until the final hearing, which could be months away. They also tend to establish a status quo that courts are reluctant to change unless there's good reason.

Issue narrowing. The magistrate identifies which issues the parents agree on and which remain disputed. Uncontested issues can be resolved immediately. Contested issues get referred to mediation.

Referral to mediation. If parenting issues are unresolved, the magistrate refers the case to CADRES (Court Alternative Dispute Resolution Service) for mandatory mediation.

Discovery scheduling. The magistrate sets deadlines for exchanging financial documents, appraisals, and other evidence.

How to Prepare

Complete your FM-050 and FM-040. These are the Child Support Affidavit and Child Support Worksheet. Gather recent tax returns, pay stubs, childcare receipts, health insurance statements, and documentation of any non-wage income. Sign the affidavit under oath before a notary.

Bring a proposed parenting schedule. The magistrate may ask what arrangement you're requesting. Having a specific, detailed proposal — not just "I want 50/50" — shows preparation and gives the magistrate something concrete to work with.

Bring documentation of your involvement. School communications, medical appointment records, and evidence of daily caregiving help establish your role as an active parent if temporary custody arrangements are contested.

Can You Skip the CMC?

Only if both parents file a Certificate in Lieu of Case Management Conference (Form FM-054), which requires a signed, comprehensive temporary agreement on all child-related issues. If you and your co-parent have already agreed on everything, this saves a court appearance. Otherwise, attendance is mandatory.
