The Registry Rejects Incomplete Packages

The BC Supreme Court registry does not process partial submissions. If your desk order application is missing a single form, has an unsigned page, or lacks a required exhibit, the entire package comes back. This is why knowing the complete list of documents before you start is more important than knowing the legal nuances of any individual form.

Here is the core document set required for a standard BC desk order divorce, organized in the order you need to prepare and file them.

Phase 1: Pre-Filing Documents

Original marriage certificate. The government-issued certificate from Vital Statistics — not the decorative one from the ceremony. If lost, order a replacement from BC Vital Statistics (CA$27 standard, CA$50 certified). If issued in a foreign language, you also need a certified English translation and a sworn Affidavit of Translation.

Copies and linking documents (if applicable). Bring photocopies of the documents you file, photo identification for swearing affidavits, and any legal change-of-name certificate or prior court order relevant to your case.

Separation agreement (recommended but not legally required). A signed agreement covering parenting, support, and property. While not mandatory for the divorce itself, having one resolves the issues the judge must verify before signing the order. Filing the separation agreement first (CA$30 fee) can also reduce your Notice of Family Claim filing fee from CA$200 to zero.

Registration of Divorce Proceedings form. Completed through the federal government's online portal and printed for filing. This initiates the Ottawa clearance search — the mandatory nationwide check for competing divorce filings.

Phase 2: Opening the Court File

Notice of Family Claim (Form F3) — for sole applications. Complete Schedule 1 (requesting the divorce order). Also complete Schedule 2 (children), Schedule 3 (spousal support), or Schedule 4 (property) as applicable. Filing fee: CA$200.

OR

Notice of Joint Family Claim (Form F1) — for joint applications where both spouses file together. Filing fee: CA$200 (or no fee if a separation agreement was already filed).

File these at the Supreme Court registry along with the marriage certificate and the Registration of Divorce Proceedings form. The registry fee for the Registration is CA$10.

Phase 3: Service (Sole Applications Only)

Affidavit of Personal Service (Form F15). After a third-party server delivers the Notice of Family Claim to your spouse, the server swears this affidavit confirming the date, time, and manner of service. A photograph of the respondent must be attached as an exhibit.

If your spouse cannot be found, you will instead need:

  • Requisition for order without notice (Form F29)
  • Supporting affidavit (Form F30) documenting your search efforts
  • Draft order for substituted service (Form F34)

Phase 4: The Desk Order Package

After the 30-day response window (sole applications) or immediately (joint applications), and once the one-year separation is complete:

Requisition (Form F35). Requests the court to grant the final order without a hearing.

Requisition (Form F17). Asks the registry to search for any filed response or counterclaim.

Affidavit — Desk Order Divorce (Form F38). Your sworn statement covering both spouses' details, dates of marriage and separation, and proof that reconciliation is not possible.

Child Support Affidavit (Form F37). Required if there are dependent children. Must include income details, the support amount, and how it aligns with the Federal Child Support Guidelines. Attach the separation agreement as a lettered exhibit.

Certificate of Pleadings (Form F36). You complete the top portion; the registry clerk completes and signs the rest to certify procedural compliance.

Draft Final Order (Form F52). The actual order you are asking the judge to sign.

Filing fee for the desk order application: CA$80. Every affidavit must be filed within 30 days of being sworn.

Phase 5: Post-Order (Optional)

Certificate of Divorce (Form F56). Ordered from the registry once the divorce takes effect: on the 31st day after the judge signs the order if no formal appeal is pending. CA$40 in person, CA$50 by mail. Proves your single status for remarriage, name changes, or international purposes.
