What to Do After Divorce Is Final in Utah

The judge signed the decree. It's done. And within about 48 hours, you'll realize that "done" meant the legal part — not the administrative part.

A Utah divorce decree does not automatically update anything. Not your driver's license, not your bank accounts, not your mortgage, not your retirement accounts. Every institution that has your married name or your ex's name on an account will keep it there until you show up with a certified copy of the decree and fill out their specific paperwork.

Here's the sequence that actually matters, organized by deadline pressure.

Week One: The Emergency Items

Start at the Utah District Court clerk's office. Order at least three certified copies of your decree — you'll need one for the Social Security Administration, one for the Driver License Division, and one to keep. Certified copies cost $4 plus $0.50 per page.

Next, call your health insurance provider. If you were covered under your ex's employer plan, your eligibility ended when the final decree was entered. You have 60 days to notify the employer about federal COBRA; after the plan sends an election notice, you have 60 days from receiving it to elect continuation coverage. If the employer has 2–19 employees, Utah Mini-COBRA uses a 30-day election window from the continuation notice. You also have 60 days to enroll in a marketplace plan through healthcare.gov. Miss that window and you could be uninsured until the next open enrollment period.

Open a new individual bank account at a different institution from your joint accounts. Redirect your payroll direct deposit immediately. Then contact every joint credit card issuer and request that the accounts be frozen so no new charges can accrue.

Month One: Identity and Title Transfers

If your decree includes a name restoration order, the updates must happen in a specific sequence. The Social Security Administration comes first — submit Form SS-5 with your certified decree at your local SSA office (free of charge). The SSA database feeds everything else, so the Utah Driver License Division will reject your name change if the SSA record hasn't been updated yet.

Once your new Social Security card arrives (typically 7–10 business days), visit a Utah DLD office in person with your current license, the new card, and a certified copy of the decree. The replacement license fee is $52 for adults over 21.

For real property, you'll need to execute and record a quitclaim deed at the county recorder's office where the property is located. Utah charges a flat $40 recording fee, and you'll also need a completed Water Rights Addendum — a Utah-specific requirement even if no water rights are being transferred.

Vehicle title transfers go through the Utah DMV. The process depends on whether your names are joined by "AND" or "OR" on the current title. If it's "OR," only one signature is needed. If it's "AND," both spouses must sign — or you present the certified decree showing the vehicle was awarded to you.

Months Two and Three: Financial Division

This is where retirement accounts, mortgage refinancing, and estate planning updates live.

A divorce decree cannot divide a retirement account on its own. Private employer plans (401(k), 403(b), pensions) require a separate Qualified Domestic Relations Order filed with the plan administrator. Utah public employee pensions under URS require a Domestic Relations Order — they will not accept a standard QDRO. IRAs are the exception: they transfer tax-free between spouses under IRC § 408(d)(6) via a trustee-to-trustee transfer authorized by the decree language.

If your decree orders your ex to refinance the mortgage into their name alone, track that deadline. Until the refinance is complete, you remain jointly liable to the lender regardless of what the decree says.

Update your will, power of attorney, and advance health care directive. Utah Code § 75-2-804 automatically revokes many spousal designations upon divorce, but ERISA-governed employer benefits — life insurance, 401(k) beneficiaries — are federally exempt from that protection. If your ex is still listed as the beneficiary on your employer life insurance, the plan administrator must pay them. Update every beneficiary form directly with the plan.

The Tax Season Reset

The IRS determines your filing status based on your marital status on December 31. If your final decree was entered on or before December 31, you file as Single or Head of Household for the entire tax year — even if you were married for 11 months of it.

Submit a new W-4 to your employer immediately after the decree to adjust your withholding. Moving from "Married Filing Jointly" to "Single" changes your tax bracket significantly, and waiting until April to discover you owe thousands is a fixable problem that most people don't fix in time.
