Updating Beneficiaries After Divorce in the UK

Your will does not control everything. Private pensions, death-in-service benefits, and life insurance policies are paid to whoever is named on the beneficiary nomination form — not whoever is in your will, and not whoever a divorce order says should receive them.

If your ex-spouse is still listed as your nominated beneficiary and you die tomorrow, the trustees will almost certainly pay the lump sum to them. A new will does not override this. A Final Order does not override this. Only updating the nomination form does.

What Sits Outside Your Will

Three categories of assets bypass your estate entirely and are paid at the discretion of scheme trustees based on your most recent nomination:

Pension death benefits. If you die before drawing your pension, the scheme pays a lump sum (typically two to four times your salary for defined benefit schemes, or the full pot for defined contribution schemes) to whoever is on the "Expression of Wish" form.

Death-in-service benefits. Most employers provide a death-in-service benefit — a tax-free lump sum paid if you die while employed. This is separate from your pension and is governed by a separate nomination form held by your employer or their group life insurer.

Life insurance policies. If you hold a personal life insurance policy and your ex-spouse is named as the beneficiary, the payout goes to them unless you change it. Joint life policies taken out during the marriage need particular attention — you may need to cancel and replace them with a sole policy.

How to Update Each One

Workplace Pension

Contact your employer's HR department or pension administrator and request an Expression of Wish form (some schemes call it a "Nomination of Beneficiary" form). Complete it naming your children, a new partner, or another person as beneficiary. Return it to the scheme administrator — they will update their records.

Trustees are not legally bound by your nomination (that is why it is called a "wish"), but in practice they follow it in the vast majority of cases. The nomination simply tells them who you intended to benefit.

Death-in-Service Benefit

This is a separate form from your pension nomination, even though it may be administered by the same employer. Ask HR specifically for the death-in-service nomination form. Some employers bundle both into one form; others keep them separate.

Private Pensions and SIPPs

Contact your provider directly. Most allow you to update beneficiary details online or by downloading a form from their website. For older policies, you may need to write to the provider.

Life Insurance

Contact your insurer to remove your ex-spouse and name a new beneficiary. If the policy was a joint life policy (first death or second death), it may need to be cancelled entirely and replaced with individual cover. Get quotes for new cover before cancelling the old policy — your age and health at the time of the new application will determine the premium.

When to Do This

Immediately after separation — do not wait for the Final Order. These nominations can be changed at any time and do not require a sealed divorce order. Update them the moment you separate, then review them again after the Final Order to ensure everything is consistent with your financial settlement.

If you die during the separation period before the Final Order is granted, your estranged spouse is still legally your spouse and may inherit under your current will or intestacy rules. Updating beneficiary nominations early provides a layer of protection during this vulnerable window.
