Separated Under One Roof in NZ: How to Prove It for Your Divorce

Moving out is not always practical when a relationship ends. Housing costs, children's school zones, and shared mortgages keep many New Zealand couples under the same roof long after they have decided the marriage is over. The law accommodates this — but the evidentiary bar is higher than for couples living at separate addresses.

The Legal Position

New Zealand's Family Proceedings Act 1980 does not require physical separation into different houses to start the two-year dissolution clock. The court recognises that parties can be "living apart" while inhabiting the same dwelling, provided they are genuinely leading separate lives.

What the court wants to see is a complete cessation of the relationship as a functioning partnership. Living in the same house while sleeping in separate bedrooms is a start, but on its own it is not enough.

What the Court Looks For

When you file your dissolution application and declare that your separation began while living under the same roof, the Registrar or Judge assesses whether the relationship had genuinely ended. The key indicators:

Separate sleeping arrangements. This is the baseline — separate bedrooms, with no sexual relationship continuing.

Separate finances. Joint accounts closed or frozen, individual bill payments, no shared discretionary spending. If you are still splitting groceries and streaming subscriptions as a household unit, the picture is weaker.

No shared domestic life. Cooking and eating separately, doing your own laundry, not functioning as a domestic team. Sharing childcare responsibilities does not undermine your case — the court distinguishes between co-parenting logistics and living as a couple.

No public presentation as a couple. Not attending social events together as partners, not introducing each other as husband and wife, not sharing family holidays.

Communication limited to logistics. Conversations about bills, the children, and household maintenance are expected. Emotional intimacy, couple-oriented planning, and joint social life are not.

How to Document It

The strongest same-roof separation cases have contemporaneous evidence — things created at the time, not reconstructed later for the application:

  • A written agreement between you and your spouse recording the separation date and the domestic arrangements you have put in place
  • Communications (texts, emails) that reflect the new living arrangement
  • Separate bank account statements from the separation date onward
  • Third-party awareness — friends, family, or a counsellor who knew you had separated while still sharing the house

Your dissolution affidavit will include a statement about the separation date and how you were living apart. If both parties file a joint application and agree on the date, that agreement may reduce factual dispute, but the court still assesses whether the statutory requirement is met. Same-roof separation becomes more contested in sole applications where the respondent may dispute when the relationship actually ended.

The Reconciliation Overlap

If you are separated under one roof and then genuinely try to reconcile — resuming the full relationship, not just relaxing some of the boundaries — the three-month reconciliation allowance under Section 40 applies. But proving that you reconciled and then re-separated while never leaving the same house requires especially clear documentation of both transitions.

Every month of same-roof separation counts toward your two-year requirement, exactly the same as if you had moved out. Many people delay their dissolution application because they assume the clock only starts when someone physically leaves the house.
