Can You Remarry After Divorce in North Dakota?

North Dakota places no statutory waiting period between a final divorce and remarriage. The moment the District Court clerk enters your decree, you're legally free to marry again. Under N.D.C.C. § 14-05-02, there's no mandatory cooling-off period and no required interval before applying for a new marriage license.

That makes North Dakota more permissive than states like Texas (which imposes a 30-day waiting period) or Alabama (60 days). But "no waiting period" doesn't mean "no requirements."

The Certified Decree Requirement

When you apply for a marriage license at a North Dakota county recorder's office, both applicants must provide certified copies of all prior divorce decrees. Not just the most recent one — every prior divorce, if there have been multiple.

This is an administrative requirement, not a legal restriction. The county recorder uses the decrees to verify that both applicants are legally free to marry. Without them, the license won't be issued.

If you divorced in North Dakota, certified copies come from the Clerk of the District Court in the county where the divorce was filed. Fees range from $10–$25 per copy depending on the county. If you divorced in another state, you'll need to contact that state's clerk of court or vital records office.

Plan ahead on this — ordering certified copies from out-of-state can take 2–4 weeks by mail.

The Appeal Window Consideration

While there's no remarriage waiting period, there is a 60-day appeal window. Under North Dakota Rule of Appellate Procedure 4(a)(1), either party can appeal the final divorce judgment within 60 days of service of the notice of entry of judgment.

Remarrying during this window is legally permitted, but it can complicate matters if the divorce is later reversed or modified on appeal. If the property division or spousal support terms are being contested, remarrying before the appeal window closes doesn't affect the appeal itself — but it can create complicated asset-tracing issues if the original decree is modified.

This is mostly a concern for contested divorces with significant assets at stake. For uncontested cases where both parties signed a stipulated agreement, the appeal risk is minimal.

Administrative Steps Before Remarriage

Before you walk into the recorder's office for a new marriage license, make sure these items are already handled:

Name consistency. If you restored your former name in the divorce decree and have already updated your Social Security card and driver's license, use that restored name on the marriage license application. If you haven't updated yet, use whatever name is currently on your government-issued ID.

Prior divorce documentation. Gather certified copies of every prior divorce decree for both applicants. County recorders will not accept photocopies.

Beneficiary and estate planning updates. If you haven't already updated your will, beneficiary designations, and powers of attorney after the previous divorce, do it before — not after — the new marriage. Getting married creates a new set of legal defaults that can override your existing estate plan in unexpected ways.

When the Decree Restricts Remarriage

In rare cases, a North Dakota divorce decree may include specific restrictions as part of a negotiated settlement. For example, a spousal support provision might terminate upon remarriage.
