Quebec Divorce Certificate: How to Get It and What the 31-Day Wait Means

The judge signs your divorce judgment, and you assume you're done. You're not — at least not for another 31 days. That gap between the judgment and the certificate catches many people off guard, especially when they need proof of single status for a new marriage, immigration paperwork, or financial account changes.

Divorce Judgment vs. Divorce Certificate

These are two different documents serving different purposes.

The divorce judgment (jugement de divorce) is the judge's decision. It outlines all the terms of your divorce — custody arrangements, support obligations, property division orders. This is the ruling itself.

The divorce certificate (certificat de divorce) is the administrative document that confirms your marriage has been legally dissolved. This is what banks, immigration authorities, and civil registries ask for when they need proof you're no longer married.

You cannot get the certificate until 31 days after the judgment date. This isn't optional — Section 12(1) of the federal Divorce Act requires it.

Why the 31-Day Waiting Period Exists

The 31-day window is the appeal period. Either spouse can appeal the divorce judgment within those 31 days. During this time, you remain legally married.

If neither spouse appeals, the divorce takes effect automatically on the 31st day after the judgment. You don't need to do anything to make this happen — the legal dissolution occurs by operation of law.

However, obtaining the actual certificate document requires a separate step.

How to Request Your Certificate

Once the 31-day appeal window has passed, contact the Superior Court registry in the judicial district where your divorce was granted. You'll need to:

1. Submit a request for a certified copy of the Certificate of Divorce — some districts use Form SJ-1078A.
2. Pay the certificate fee, which ranges from $7 to $10 depending on the district.
3. Wait for processing, which typically takes a few days to a few weeks depending on the court's backlog.

Keep in mind that the court does not automatically mail you a certificate. You must proactively request it.

What You Can Do With the Certificate

The divorce certificate is the document you'll need for:

• Remarriage — the Directeur de l'etat civil requires it before issuing a new marriage licence.
• Immigration applications — IRCC requires proof of marital status changes.
• Financial institutions — banks and pension administrators may require it to process account changes or pension splits.
• Name changes — if reverting to a birth name, some institutions require the certificate alongside other documentation.

Don't Forget Pension Transfers

The certificate confirms your divorce is final, but it doesn't automatically trigger the division of pension assets. If your divorce agreement includes a split of QPP credits or employer pension benefits, you must separately contact Retraite Quebec or the pension plan administrator to initiate the actual transfer. This step has its own paperwork and processing timeline.

Keep Multiple Certified Copies

Order at least two or three certified copies of your divorce certificate. Different institutions will want originals — not photocopies — and processing times for replacement copies can add weeks when you need one urgently.
