A QDRO is the only legal way to divide an employer-sponsored retirement plan — 401(k), 403(b), or private pension — without triggering taxes and penalties. Wisconsin courts use QDROs for private-sector plans, but if your spouse works for the state or a municipality, you need a different document: the Wisconsin Retirement System (WRS) Domestic Relations Order.
Getting this wrong means months of delays and potentially thousands in unnecessary taxes.
What a QDRO Does
A Qualified Domestic Relations Order is a separate court order — distinct from your divorce judgment — that directs a retirement plan administrator to pay a portion of one spouse's retirement benefits directly to the other spouse (the "alternate payee").
Without a QDRO, the plan administrator cannot legally divide the account. Your divorce decree alone isn't enough — ERISA (the federal law governing employer retirement plans) specifically requires this separate order.
When drafted correctly and the divided funds are transferred directly into the alternate payee's IRA, the transfer remains tax-deferred and avoids the 10% early withdrawal penalty.
The QDRO Process Step by Step
1. Draft the QDRO. This is typically done by a specialized QDRO preparer or your attorney. The order must specify the plan name, participant, alternate payee, and the amount or percentage to be awarded. Plans have strict formatting requirements.
2. Get pre-approval from the plan administrator. Before the judge signs, send the draft QDRO to the retirement plan's administrator for review. They'll confirm whether the order meets their plan's requirements. This step is critical — submitting a signed QDRO that the plan rejects means going back to court for a corrected order.
3. Get the judge's signature. Once the plan pre-approves the language, file the QDRO with the Wisconsin Circuit Court. The judge reviews and signs it.
4. Send the certified order to the plan. Mail the signed, certified copy to the plan administrator. They process the division — typically within 60-90 days.
5. The alternate payee rolls over their share. The divided funds are transferred into the alternate payee's individual IRA via a direct rollover. No taxes. No penalties.
The Wisconsin Retirement System (WRS) DRO
If your spouse is a state or municipal employee, their pension is in the WRS — a governmental plan exempt from ERISA. You cannot use a standard QDRO. Instead, you must use the state-mandated forms from the Department of Employee Trust Funds (ETF):

Critical WRS rules that catch people off guard:
- Percentage only. The WRS will only divide the account by a specified percentage. Dollar amounts are rejected. The percentage cannot exceed 50% of the total value as of the decree date.
- Unaltered forms only. ETF rejects any DRO that is photocopied, modified, or contains handwritten alterations. You must use their official forms exactly as provided.
- Decree date definition. The WRS account is divided as of the first day of the month in which the marriage is legally terminated — not the date you filed or separated.
- Form ET-4322 required. The member-spouse must submit a Military Service Certification and Affidavit, even if they never served. It certifies whether military service credits affect the benefit calculation.

Common QDRO Mistakes
Waiting too long. There's no deadline for filing a QDRO, but delays are dangerous. If the employee spouse retires or takes a distribution before the QDRO is filed, the alternate payee may lose their share.
Using generic templates. Every plan has different requirements. A QDRO that works for a Fidelity 401(k) might be rejected by a Vanguard plan. Always get pre-approval from the specific plan administrator.
Forgetting to file. Shockingly common. The divorce is finalized, life moves on, and neither spouse files the QDRO. Years later, the alternate payee discovers the retirement account was never actually divided.
Confusing IRA division with QDRO. IRAs don't need QDROs — they use a "transfer incident to divorce" under IRC § 408(d)(6). Filing a QDRO for an IRA wastes time and money.
Cost and Timeline
QDRO preparation typically costs $500-$1,500 depending on complexity. The WRS DRO process is free (no filing fee to ETF). Total timeline from drafting to completed division: 3-6 months for private plans, 2-4 months for WRS.
