QDRO in a Delaware Divorce: What It Is and When You Need One
A Qualified Domestic Relations Order is a legal document that tells a retirement plan administrator to divide a retirement account between divorcing spouses. Without one, transferring funds out of a 401(k), 403(b), or pension plan triggers income taxes and potentially a 10% early withdrawal penalty. The QDRO makes the transfer tax-free.
When You Need a QDRO
You need a QDRO whenever you're dividing an employer-sponsored retirement plan — 401(k), 403(b), 457(b), pension, or thrift savings plan. The QDRO is separate from your divorce decree and property settlement agreement. The settlement agreement says what each spouse gets; the QDRO instructs the plan administrator how to execute the transfer.
You do not need a QDRO for:
- IRAs — divided via a direct trustee-to-trustee transfer under IRC § 408(d)(6), using the court's property division order
- Military pensions — divided under the Uniformed Services Former Spouses' Protection Act (USFSPA), which has its own order format submitted to DFAS
The Step-by-Step Process
1. Get the Plan's QDRO Guidelines
Contact the plan administrator and request their specific QDRO procedures and model language. Many plans have a pre-approved template. Using it dramatically increases the chance of first-pass approval.
2. Draft the QDRO
The order must specify:
- The plan name and administrator
- Both spouses' names, addresses, and Social Security numbers
- The exact dollar amount or percentage to be transferred
- Whether the alternate payee (non-employee spouse) receives a separate account or shared payments
- Survivor benefit designations
For pensions, the QDRO must specify whether the Cooper Formula coverture fraction is used and the division percentage.
3. Submit for Pre-Approval
Send the draft QDRO to the plan administrator for review before filing it with the court. Most administrators take 2 to 6 weeks to review. They'll flag any language that conflicts with plan rules. Skipping this step risks having a judge-signed order rejected by the plan.
4. File with Delaware Family Court
Once the plan administrator approves the draft, file it with the Family Court. A judge reviews and signs the order.
5. Send the Signed Order to the Plan
The plan administrator receives the court-signed QDRO, processes it, and transfers the awarded amount into a new retirement account in the alternate payee's name.
QDRO Costs
Professional QDRO preparation services charge $300 to $400 per retirement plan on a flat-fee basis. Attorney-drafted QDROs may cost more depending on hourly rates. If multiple plans need to be divided, each requires its own QDRO.

Common QDRO Mistakes
Waiting too long. There's no statutory deadline to file a QDRO in Delaware, but delays create risk. If the employee spouse retires, changes jobs, or dies before the QDRO is filed, the alternate payee's rights may be difficult or impossible to enforce.
Forgetting survivor benefits. A standard pension stops paying when the retiree dies. The QDRO must explicitly designate the alternate payee as a beneficiary for both Pre-Retirement Survivor Annuities (protection if the employee dies before retirement) and Post-Retirement Joint and Survivor Annuities. If the QDRO omits these designations and the retiree dies, the alternate payee's payments end permanently.
Not getting pre-approval. Filing a QDRO with the court before the plan administrator reviews it is a gamble. If the plan rejects the language, you'll need to amend and refile — adding months and additional legal fees.
