Name Change After Divorce in Utah

The cheapest and simplest way to change your name after a Utah divorce is to include the name restoration order directly in the decree. If that's already done, skip ahead to the update sequence below. If it isn't — if your decree was signed without name restoration language — you're looking at a more expensive path.

If Your Decree Includes the Name Change

When a Utah judge signs a decree that contains explicit name-restoration language (identifying both your married name and the exact spelling of your restored name), that decree is your legal authority. No separate petition needed, no hearing, no additional filing fee. You just need certified copies.

If Your Decree Doesn't Include It

You cannot retroactively amend a finalized decree to add a name change. Instead, you must file a separate Petition for Name Change in Utah District Court. This path requires:

• One year of county residency before filing
• A filing fee of $375 (fee waiver available for qualifying applicants)
• A background check through the Utah Department of Corrections Offender Registration Program, which takes three to five weeks to process
• A court hearing where a judge reviews and signs a separate Order on Petition for Name Change

Either way, once you have the legal authority document (the decree or the separate order), the update sequence is identical — and the order matters.

Step 1: Social Security Administration

The SSA must be updated first. The Utah Driver License Division verifies your identity against the SSA database in real time, so if those records don't match, DLD will reject your name change on the spot.

Visit your local SSA office with:

• Completed Form SS-5 (Application for a Social Security Card)
• Certified copy of the divorce decree or name change order
• Proof of identity (current driver's license or unexpired passport)

There's no fee. Your new card arrives by mail in 7–10 business days, but the database typically updates within 24–48 hours.

Step 2: Utah Driver License Division

Once the SSA database is current, visit a Utah DLD office in person. You'll need:

• Your current Utah driver's license
• Your new Social Security card
• A certified copy of the divorce decree or name change order

The replacement license fee is $52 for adults over 21. You'll get a temporary license the same day, with the physical card mailed within four to six weeks.

Step 3: Everything Else

With the SSA and DLD updated, you can move through the remaining institutions:

• Banks and credit cards: Bring the new driver's license and a certified copy of the decree. Most banks also want the new Social Security card.
• Employer payroll: Submit a new W-4 with your updated name. State employees use the Vantage system and upload an image of the new Social Security card.
• Passport: Submit Form DS-5504 if your passport was issued less than one year ago; otherwise use Form DS-82 if eligible or Form DS-11 if not, with the certified decree.
• Utah birth certificate (optional): Submit a Court Order Amendment Form, a certified copy of the court order, and $65 to the Utah Office of Vital Records in Salt Lake City.
• Vehicle titles: If your name changed, bring the decree and new license to a DMV office or use the UPP online portal.
• Utah DLD name change for CDL holders: Commercial driver's license holders follow the same in-person process but must present additional federal documentation.
