Manitoba Family Court: The Process from Filing to Triage Conference

Manitoba's family court system is designed to keep parents out of the courtroom. The Court of King's Bench (Family Division) enforces mandatory prerequisites that must be completed before you can get a judge's attention. Understanding this process — and what happens if you skip steps — prevents costly delays.

The Mandatory "For the Sake of the Children" Course

Before requesting any contested court date involving parenting time or decision-making responsibility, every parent must complete "For the Sake of the Children." There are no exceptions unless:

• The other parent lives entirely outside Manitoba
• You have a full written consent agreement
• Your application is completely unopposed
• You completed the course within the past three years

What the course covers:

• How children experience separation at different developmental stages
• Communication techniques to reduce parental conflict
• Financial impacts of divorce on families
• Drafting realistic parenting plans

Format: Free, self-paced, online — takes approximately four hours. After completion, you sign an Acknowledgment of Completion Form and file it with the Court of King's Bench Registry, which issues a Certificate of Prerequisite Completion (Form 70D.3).

The Step-by-Step Court Process

Step 1: Filing Your Application

File a Form 70A (Petition) or Form 70B (Petition for Divorce) at the Court of King's Bench Registry. Filing fee: CA$200 (includes Central Divorce Registry search). You need at least one year of Manitoba residency for a divorce petition.

Step 2: Service and Response

The other parent must be personally served. They have 20 days to file a response (Form 70E Answer) at a cost of CA$50. If they're in the US, they get 40 days; internationally, 60 days.

Step 3: Prerequisites

Both parents must:

• Complete "For the Sake of the Children" and file the certificate
• Exchange full financial disclosure (Form 70D Financial Statement + three years of tax returns)
• Attempt dispute resolution through the Family Resolution Service

Step 4: Request for Triage Screening

Once prerequisites are satisfied, file a Request for Triage Conference (Form 70D.2) along with your Certificate of Prerequisite Completion (Form 70D.3) and a Triage Brief (Form 70D.4). Filing fee: CA$50.

Serve these materials on the other parent at least 14 days before the screening date. They must respond at least 4 days before.

Step 5: The Triage Conference

A settlement-focused, non-record meeting with a duty judge. The goal is narrowing or resolving issues without a full trial. If urgent matters exist, the judge can order a Prioritized Hearing within 30 days.

The Three-Times Strike-Off Rule

Effective February 2026: if your case appears on the Triage Screening List three times without both parties having their documents fully filed, it's automatically struck off. To restart, you file a new Request for Triage Conference and pay the fee again. This rule exists to prevent indefinite procedural stalling.

Emergency Exceptions

You can bypass all prerequisites under King's Bench Rule 70.24(12) if there's:

• Immediate risk of harm to a parent or child
• Imminent risk of child abduction
• Risk of property destruction
• Extreme financial hardship (pilot project — must first apply to the Child Support Service)
