Legal Aid Queensland (LAQ) provides free or subsidised legal assistance to people who can't afford a private family lawyer. For property settlement, this can mean the difference between walking away with a fair share and being out-negotiated because you couldn't afford representation. But the eligibility criteria are strict, and property matters are harder to get funded than parenting disputes.

Who Qualifies

LAQ assesses applications based on three criteria:

Means test: Your income and assets must fall below LAQ thresholds. Generally, this means you're on a Centrelink payment, earn a low wage, or have minimal savings. Owning the family home doesn't automatically disqualify you — it depends on your accessible liquid assets and income after separation.

Merit test: LAQ evaluates whether your case has reasonable prospects of success. For property settlement, this means there needs to be a genuine dispute and a realistic chance of achieving a better outcome through legal action than you'd get without it.

Appropriateness test: LAQ considers whether a grant of aid is the most effective use of limited public funds. Simple property matters where the pool is small may not justify the cost of a lawyer.

What Services Are Available

Legal information and advice: Anyone can call LAQ's helpline or attend a free advice session regardless of income. This includes brief advice about property settlement rights, time limits, and process.

Duty lawyer services: Available at FCFCOA registries in Brisbane and regional centres for people appearing without a lawyer. Duty lawyers can provide on-the-day assistance with procedural matters.

Family Dispute Resolution (FDR): LAQ funds mediation sessions through its own dispute resolution centres. If you qualify, mediation is free. This is often the most accessible LAQ service for property disputes.

Grants of legal aid for representation: The hardest to obtain for property matters. LAQ prioritises cases involving family violence, significant power imbalance, or complex legal issues. A straightforward property division where both parties are capable of self-representing is unlikely to receive a full grant.

What LAQ Doesn't Cover

LAQ doesn't typically fund:

  • Property settlements where both parties have the capacity to negotiate directly
  • Cases where the legal costs would exceed the likely benefit
  • BFA (Binding Financial Agreement) preparation — these require independent lawyers for each party, which doesn't align with LAQ's model
  • Queensland-specific conveyancing steps like title transfers and stamp duty exemptions

If You Don't Qualify
