Las Vegas Divorce Process: Clark County Filing Guide

Clark County handles roughly 70% of all divorce filings in Nevada. If you or your spouse lives in Las Vegas, Henderson, North Las Vegas, or anywhere else in Clark County, your case goes through the Eighth Judicial District Court's Family Division.

The process follows the same Nevada statutes as every other county, but Clark County has its own local rules (EDCR), its own e-filing system, and several requirements that don't exist elsewhere in the state. Here's what you need to know.

Filing Through eFileNV

Clark County requires electronic filing through the eFileNV system for most documents. You'll create an account, select "Eighth Judicial District Court," and choose the Family Division.

The most common rejection in eFileNV is uploading all your forms as a single PDF. Clark County requires each document as a separate file:

• Family Court Cover Sheet — separate PDF
• Complaint for Divorce (or Joint Petition) — separate PDF
• Summons — separate PDF, filed with the code "SEI"
• Joint Preliminary Injunction — separate PDF

Each upload carries a $3.50 per-transaction surcharge on top of the filing fee. A Complaint for Divorce costs $364, a Joint Petition without children costs $328, and with children it's $342.

After filing, the system assigns your case a number and a judicial department. Note the department — all future filings, motions, and hearings will be routed there under Clark County's "One Family, One Court" rule (EDCR 5.42).

The Joint Preliminary Injunction

When you file a unilateral Complaint in Clark County, the clerk automatically issues a Joint Preliminary Injunction (JPI) under EDCR 5.518. This is a mutual restraining order that's binding on you immediately upon filing and on your spouse upon service.

The JPI prohibits both spouses from:

• Selling, transferring, hiding, or disposing of community or separate property
• Changing beneficiaries on insurance policies or retirement accounts
• Incurring significant new debt
• Moving minor children out of Nevada without written consent or a court order

Violating the JPI has real consequences. In Lofgren v. Lofgren, the Nevada Supreme Court upheld deducting the value of diverted funds from a violating spouse's share of the remaining community assets.

Clark County Parenting Requirements

Cases involving minor children trigger two additional requirements:

Seminar for Separating Parents. Both parents must complete a court-approved parenting class within 45 days of service. Clark County's Family Law Self-Help Center maintains a list of approved providers. Fees run $40 to $50. The court won't sign your decree until both completion certificates are filed.

Family Mediation Center. If parents disagree on custody or visitation, the court refers them to the Family Mediation Center (FMC) for mandatory mediation. FMC mediators help parents draft a Parenting Agreement covering timesharing, holidays, and transportation. Fees use a sliding scale based on gross monthly income — free for low-income families, up to $300 at higher incomes. FMC handles custody disputes only, not financial issues.

One Family, One Court

Under EDCR 5.42, if you or your spouse has any prior family-related case in Clark County — child support, a domestic violence protection order, a guardianship — your divorce case must be assigned to the same judicial department. Identify all prior cases on your Family Court Cover Sheet. Missing a prior case means your filing gets bounced to the wrong department and rerouted, adding weeks to your timeline.

Filing Fee Waivers in Clark County

Clark County processes fee waiver applications under NRS 12.015. If approved, the waiver covers all clerk-assessed filing fees and gets the Clark County Sheriff to serve your papers for free. Apply by filing an Application to Proceed In Forma Pauperis and a proposed Order to Waive Filing Fee with your initial documents.
