Indiana Public Pensions Follow Different Rules

If you or your spouse is a state employee, public school teacher, police officer, or firefighter in Indiana, the retirement benefit is administered by the Indiana Public Retirement System (INPRS). INPRS manages several funds — the two largest are PERF (Public Employees' Retirement Fund) and TRF (Teachers' Retirement Fund).

These government pensions are exempt from the federal ERISA statute that governs private-sector 401(k)s and pensions. A federal QDRO — the standard tool for splitting private retirement plans — will not work for INPRS accounts. The plan will reject it.

What You Need Instead: A State DRO

Indiana public pensions require a state-specific Domestic Relations Order (DRO). This order must conform to INPRS-approved language and be entered by the court that granted the divorce.

The drafting requirements are strict. INPRS publishes model DRO language and guidelines specifying exactly what the order must include:

  • The member's full name, date of birth, and INPRS member ID
  • The alternate payee's full name, date of birth, and Social Security number
  • The specific fund (PERF, TRF, or another INPRS-administered plan)
  • The formula or percentage for dividing the benefit
  • For the defined benefit pension, whether the alternate payee's share begins when the member retires and starts drawing payments

Using generic divorce decree language or a private-sector QDRO template is the most common reason for rejection. Contact INPRS directly or work with an attorney experienced in Indiana public pension division to draft the order correctly the first time.

The 30-Day Administrative Waiting Period

After INPRS receives a certified copy of the court-entered DRO, the system imposes a mandatory 30-day administrative review period. During this window, the INPRS legal team reviews the order for compliance with state pension statutes. Only after the review is complete and the order is accepted does INPRS update the member's record.

If the DRO contains errors or non-compliant language, INPRS will return it with corrections. The order must be amended, re-entered by the court, and resubmitted — restarting the 30-day clock.

How the Benefit Is Divided

The method depends on the type of account:

PERF Defined Benefit pension: The monthly retirement benefit is divided according to the DRO formula. INPRS cannot pay a lump sum from the defined benefit stream — the alternate payee receives a monthly payment only after the member retires and begins drawing benefits. If the member has not yet retired, the alternate payee waits.

PERF Defined Contribution (My Choice) account: The DRO can direct a division of the account balance. The alternate payee can establish an independent account within INPRS or roll their marital share into an outside IRA.

TRF Hybrid Plan: This plan has two components — a Defined Benefit pension and a Defined Contribution account (formerly the Annuity Savings Account). The DB pension follows the same rules as PERF: monthly payments only, no lump sum. The DC account can be divided and rolled over.

The Coverture Fraction

When part of the pension was earned before the marriage, Indiana courts use the coverture fraction to isolate the marital portion:

Coverture Fraction = Years of Plan Participation During the Marriage / Total Years of Plan Participation at Retirement

The marital share of the monthly benefit equals the total benefit multiplied by the coverture fraction, then multiplied by the awarded percentage (typically 50%).

Because defined benefit pensions do not have a simple cash balance, high-asset divorces sometimes use an actuarial valuation to determine the present value of the future benefit stream. The non-employee spouse can then receive other marital assets of equal value — cash, real estate, or investment accounts — instead of waiting for monthly payments through a long-term DRO.

Survivor Benefits

If the member dies before the alternate payee begins receiving payments, the alternate payee's rights depend on the DRO language and the specific INPRS plan rules. Some plans provide survivor benefit protections that preserve the alternate payee's share; others do not.

The DRO should explicitly address survivor benefits. If the order is silent on this point and the member dies, the alternate payee may lose their entire share. This is one of the most consequential drafting details in public pension division — do not leave it unaddressed.

Social Security and Public Pensions After the SSFA Repeal

The Social Security Fairness Act (H.R. 82, signed January 5, 2025) repealed the Government Pension Offset and Windfall Elimination Provision. Indiana public employees who receive INPRS pensions and were previously subject to reduced Social Security benefits should verify that the SSA applied the automatic retroactive adjustments back to January 2024. Those who never applied for divorced-spouse or survivor Social Security benefits because the old rules would have reduced them to zero should file immediately — the SSA does not automatically enroll them, and retroactive payments for new applicants are limited to six months before the application date.
