How to Value Assets for Divorce in Delaware

Before Delaware Family Court can divide your marital estate, every asset needs a defensible value. The court won't accept guesses or "we think it's worth about..." for anything significant. Different asset types require different valuation methods, and getting the valuation date wrong can shift thousands of dollars between spouses.

Valuation Dates Matter

Delaware courts generally value the marital estate as of the date of separation — the date the parties began living separate and apart. However, the court has discretion to use a different date (such as the trial date) if circumstances warrant it.

For pensions, the rules are different. The marital portion of a pension continues to accrue from the date of marriage through the date of the divorce decree, not the date of separation. If a couple separates but takes years to finalize the divorce, the non-employee spouse's pension share keeps growing.

Real Estate

A certified residential appraisal is the standard for homes and investment property. Appraisals typically cost $300 to $600 in Delaware. The appraiser inspects the property and produces a report based on comparable recent sales.

If both spouses disagree on value, each can hire their own appraiser, and the court resolves the difference. In some cases, the court appoints a neutral appraiser.

For the equity calculation, subtract the outstanding mortgage balance and any liens from the appraised fair market value.

Business Interests

Valuing a business in a Delaware divorce is complex and almost always requires a professional — a Certified Valuation Analyst (CVA) or Accredited Business Appraiser. Costs range from $3,000 to $10,000 or more depending on the business's complexity.

Common valuation methods include:

  • Income approach — values the business based on its expected future earnings
  • Market approach — compares the business to similar businesses that have recently sold
  • Asset approach — values the business based on its net assets (total assets minus liabilities)

Under the Ramon v. Ramon precedent, if a spouse with controlling ownership of a premarital business used their authority to retain earnings within the corporation during the marriage, those retained earnings may be classified as marital property.

Vehicles

Kelley Blue Book is the standard reference for vehicle values in Delaware Family Court. Use the private-party sale value, not the dealer retail or trade-in value. Include year, make, model, mileage, and condition.

Retirement and Investment Accounts

Account statements as of the valuation date provide the value for defined contribution plans (401(k), IRA, brokerage). For pre-tax accounts, an after-tax adjustment may be appropriate when comparing to post-tax assets.

Defined benefit pensions require an actuarial calculation or the Cooper Formula coverture fraction approach, since there's no liquid account balance to reference.

Personal Property

Furniture, jewelry, art, and collectibles are valued at fair market value — what a willing buyer would pay a willing seller — not replacement cost or sentimental value. For high-value items (art, antiques, jewelry collections), a professional appraisal may be warranted. For everyday household items, a reasonable good-faith estimate is usually sufficient.

Getting Organized

The more systematic your documentation, the less you'll spend on professional fees and the more credible your position in negotiations. List every significant asset with its estimated value, supporting documentation, and proposed valuation method.
