How to Remove a Spouse From a Mortgage After Divorce in Oklahoma
A divorce decree can assign the house to one spouse and order the other to sign a quitclaim deed. What it cannot do is remove a name from the mortgage. The mortgage is a contract between the borrowers and the lender, and under Stevenson v. Stevenson, a court order cannot impair that contractual relationship. If both names are on the loan, the lender retains the right to pursue both parties for payment if either one defaults.
This is one of the most dangerous misunderstandings in post-divorce property division. Here's what actually works.
Option 1: Refinance Into One Name
Refinancing is the cleanest solution. The spouse keeping the house applies for a new mortgage in their name alone, and the old joint mortgage is paid off. The departing spouse's name is removed from the debt entirely.
The catch: the remaining spouse must qualify for the new mortgage on their own income and credit. Post-divorce, when household income has just been cut, this isn't always possible. If you can't qualify, talk to your lender about what timeline might work and what income or credit improvements are needed.
Refinancing also resets your interest rate — which may be higher or lower than your current rate depending on market conditions. Run the numbers before committing.
Option 2: Mortgage Assumption
Some loans — particularly VA and FHA mortgages — allow one borrower to assume the existing mortgage, keeping the same rate and terms. The departing spouse is formally released from the obligation.
Assumptions require the lender's approval, and the assuming spouse must meet the lender's underwriting requirements. Not all loans are assumable, and conventional mortgages almost never are. Check your loan documents or call your servicer to find out whether your mortgage qualifies.
Option 3: Sell the Property
If neither refinancing nor assumption is feasible, selling the property and dividing the proceeds per the decree is the most reliable way to eliminate the joint obligation. Once the loan is paid off from sale proceeds, both names are cleared.

What a Quitclaim Deed Does (and Doesn't Do)
Recording a quitclaim deed transfers ownership of the property — but it has zero effect on the mortgage. After a quitclaim, you can be in the odd position of no longer owning the house but still being legally responsible for the mortgage payments.
If the spouse who keeps the house stops paying, the lender will come after both parties. Your credit score takes the same hit whether or not your name is on the deed. The mortgage is what matters to the lender.
File the quitclaim deed (it's required by the decree), but don't treat it as a substitute for refinancing or assumption. They solve different problems.
Protecting Your Credit in the Interim
If refinancing takes months or the decree gives a timeline for the property transfer, protect yourself:
- Monitor the mortgage payments — set up alerts through the servicer's portal so you know immediately if a payment is missed
- Keep records of every payment your ex makes, in case you need to show the court that the decree is being followed
- Set a deadline — if the decree doesn't specify when refinancing must happen, file a motion to set a reasonable timeline. Open-ended "whenever possible" language leaves you exposed indefinitely
If your ex-spouse misses payments and your credit is damaged, you can file a motion for contempt in the district court that issued the decree. But credit damage is difficult to reverse even after a contempt finding — prevention is far better.
