How to Get a Certified Divorce Order in Australia

Every post-divorce update — from your driver licence to your passport to your superannuation — requires proof that the divorce actually happened. The sealed Divorce Order from the Federal Circuit and Family Court of Australia is that proof. But it's not mailed to you, and most people aren't sure where to find it or what format agencies accept.

When the Order Becomes Available

A Divorce Order does not take effect on the day the court grants it. It becomes final exactly one month and one day after the divorce hearing. On that date, the sealed order is uploaded to the Commonwealth Courts Portal and you receive an email notification that it's ready for download.

This timing catches people out. If your hearing was on 1 March, the order becomes final on 2 April — and any attempt to start administrative updates before that date will be rejected.

Downloading From the Commonwealth Courts Portal

The Commonwealth Courts Portal is the primary source for your Divorce Order:

  1. Log into the Commonwealth Courts Portal using the credentials you created when filing
  2. Navigate to your case and find the finalised Divorce Order
  3. Download the PDF — this is an electronically sealed and signed document

The digital PDF is accepted as an original by virtually all Australian government agencies, banks, and super funds. You do not need to get it certified or stamped at a court registry — the digital seal is sufficient.

Save it securely. Store copies in multiple locations — cloud storage, a USB drive, and a printed copy in a secure place. You'll need this document dozens of times over the coming months.

What If You've Lost Access to the Portal?

If you've forgotten your login credentials or can no longer access the Commonwealth Courts Portal:

  • Use the password recovery function on the portal's login page
  • If that fails, contact the National Enquiry Centre on 1300 352 000 to request assistance with account access
  • As a last resort, you can request a replacement copy of the order by contacting the court registry where the divorce was heard

Physical certified copies are no longer mailed as a default. The electronic version is the standard, and requesting physical copies may involve additional processing time.

Agencies That Will Ask for It

Have your Divorce Order ready for:

  • NSW BDM — if applying for a formal name change
  • Service NSW / Transport for NSW — for driver licence updates (the Marriage Certificate + Divorce Order combination is your name-link proof)
  • Australian Passport Office — for passport name changes and the fee waiver
  • Banks and financial institutions — for closing joint accounts and opening individual ones
  • Super fund trustees — as part of superannuation splitting orders
  • Revenue NSW — for stamp duty exemption applications on property transfers
  • Services Australia — for updating Medicare and Centrelink records

Most agencies accept a digital PDF viewed on a phone or tablet, but some Service NSW centres still prefer printed copies. Carry both when visiting in person.

The Marriage Certificate Still Matters

The Divorce Order proves the marriage ended. But it doesn't prove what your name was before the marriage. For name-related updates, you typically need both:

  • The Marriage Certificate (proving the link between your birth name and married name)
  • The Divorce Order (proving the marriage has ended)

These two documents together let you revert to your maiden name without a formal BDM name change — saving you the $203 registration fee.
