Why Divorce Ends Eligibility for Your Ex-Spouse's Plan
If you were covered under your spouse's employer-sponsored health plan during the marriage, the divorce terminates your eligibility for coverage under that plan. Ask the plan administrator for the actual coverage-loss date and continuation options. Mississippi employers are not required to continue covering an ex-spouse on a group plan, and staying on the policy without authorization can constitute insurance fraud.
The good news: a finalized divorce is a Qualifying Life Event (QLE) under federal law when it causes you to lose coverage. That designation opens a 60-day special enrollment period where you can secure new individual coverage outside of the standard open enrollment window. Confirm the exact start and end dates with the plan or Marketplace.
COBRA: Temporary Extension at Full Cost
Under the Consolidated Omnibus Budget Reconciliation Act, employers with 20 or more employees must offer continuation coverage to ex-spouses for up to 36 months after divorce. The employer's plan administrator has 14 days after being notified of the divorce to send you the COBRA election notice, and you then have 60 days to elect coverage.
Two things to understand about COBRA in Mississippi:
- You pay the full premium plus a 2% administrative fee. During the marriage, your spouse's employer likely subsidized 50–80% of the premium. Under COBRA, that subsidy disappears. A family plan that cost your spouse $200/month in payroll deductions might run $1,800/month at full cost.
- Coverage is identical to the active-employee plan. Same doctors, same network, same prescription formulary. This can be worth the expense for a few months if you are mid-treatment or managing a chronic condition.
COBRA is a bridge, not a long-term solution. Use those first months to evaluate permanent alternatives.
Mississippi's Marketplace and Medicaid Options
Mississippi uses the federal Health Insurance Marketplace at healthcare.gov. Because divorce is a QLE when it causes loss of coverage, you can enroll in a marketplace plan during the applicable 60-day special enrollment period regardless of when open enrollment runs. You will need your finalized divorce decree and proof of the coverage-loss date from your ex-spouse's employer.
Income-based premium tax credits can significantly reduce monthly costs. Check your current household income and eligibility through healthcare.gov. Mississippi Medicaid has separate eligibility categories and thresholds; check current state rules if your income is low.

Don't Forget Your Children's Coverage
Children's health insurance is a separate matter from spousal coverage. Your children typically remain eligible for coverage under either parent's employer plan regardless of the divorce. The decree usually specifies which parent carries the children's insurance — make sure you have that language in writing and understand who is responsible for premiums and uncovered medical expenses.
If neither parent has employer-sponsored coverage, Mississippi's Children's Health Insurance Program (CHIP) covers children in families with incomes up to 209% of the Federal Poverty Level.
The 60-Day Clock Is Non-Negotiable
The biggest mistake people make with post-divorce health insurance is procrastination. Miss the 60-day QLE window, and Marketplace enrollment may have to wait until the next open enrollment period unless another special enrollment opportunity applies; COBRA and Medicaid/CHIP may still be available depending on eligibility. Put this task on your post-divorce checklist alongside getting certified copies of your decree and updating your Social Security records.
